I have know my sons mother since Oct 2002. we met in Jamaica. I was married at the time to another Jamaican ( I am a US born citizen).

in 2004 we had a son and I put them up safe in their own home. We had a normal relationship, good time and bad but we stayed together.

we are 20 years apart in age but this did not become an issue yet in fact we complimented each other.

My marriage to my wife ( we have 3 sons) still existed in an strain manner until I was convinced ( by my girlfriend) to get an divorce from my wife

and file for her ( I secured us citizenship for our son independent of this) thus in DEC 2008 i was granted a divorce and I then filed a finance petition for

my girlfriend. things were well between us and finally she received her visa and we move to the us in July 2010. within that month we got married and continued the process up to the point she received her work permit and travel documents and SS number 3 months later.

After this things basically went to hell, at first she would come and go at her leisure with no regards to my concerns. I noticed she keep he phone on silent all the time. even after receiving her work permit she made no effort to secure any employment. Things generally deteriorated for the next 5 months until my son who is 6 yo told me that he seen his mother and the neighbor kissing and how the same neighbor played ruff with him to the point it hurt and also that he notice a real gun, when he was over there with his mother, on the table.I confront her about this and she brushed it aside and continued to go there. I at this point informed her that I would be filing for an annulment/divorce and withdrawing my petition (I-864) and that I would not be going to the AOS interview.

after this she began all kinda tricks such as trying to get someone else to file for her, joining the army and finally asking me to preform fraud in order for her to stay in the country.( live separate but she do what she wants and pay me.)I told her flat out no.

One night I woke up to find she had left her email open ( a secret email address) used by her and him to communicate and I forward all this evidence to my mail and then confronted her about this she, it seems, was informed of circumventing the issue by filing a VAWA petition and twice called the police crying battery and on the 2nd instance( the night i found the email) I was arrested. ( Please note that I have pleaded not guilty) as in both cases I was trying to leave the house while being attacked by her and on the 2nd instance marks were left on her from my defensive effort. ( no damage or hospitalization needed) and I had a scratch on my face.

I filed a TPO on her and her boy friend as they have made treats to my well being and she has a TPO on me. I have moved out with our son and she has moved in with said neighbor ( who is suppose to be a friend). I have forward all this information to immigrations and thus..

1) Will she be successful in getting the VAWA petition and if not how long before she has to leave the country.

2) Will the judge award her custody of our child ( she does not having any status, job ,home, car, license and her boy friend is not working.)

3) Will I succeed in getting an annulment

Also note she has not admitted to immigrations anything regarding her friend other than a friendship not knowing they are in position of said evidence to the contrary.

Can anyone comment on this and/or send me any links that would help me understand my situation.

1. she doesn't have a VAWA case. You need to build a casefile with ICE, whilst yer waiting. Make Sure ICE has everything - but - you'll need to send out entire copies to

--National ICE office

--Local ICE Office

--USCIS local office

--US Embassy/Jamaica/IV Unit

1a. Withdraw your I-864 now, via a letter to

--USCIS local office

--USCIS National Office

2. joint, possibly. sole? no. her income will be evaluated, and IF you include all casefile info from the ICE casefile, the judge will determine she's attempting visa fraud.

3. possibly - but ya can't annul a child.

You've got seperate issues to deal with, immigration and divorce. Seek counsel elsewhere on the divorce bits, as divorce is 'county-specific' (that's c o u n t y without the 'r')

K-1 forum has to do with what needs to be attached and sent to USCIS with an I-129F when filing the petition, not about major problems with family after getting a visa, and asking about divorce and pulling sponsorship during adjustment of status.

First. This isn't immigration fraud. She's an adulteress sure.. but outside of that it doesn't appear she married you JUST for the GC. It appears she married you for money so maybe marriage fraud.. (hopefully the emails that you forwarded to yourself outline the marriage stuff)

1. The VAWA petition. This is important. You NEED to send ALL the evidence you have of her falsely accusing you to ICE. The problem is she has the police report that you were arrested for abuse so you need to overcome that.

2. Child custody - well that depends on the judge. First she will need somewhere to live. She will also need employment to support the child. The child WON'T be allowed somewhere dangerous so it's important that you inform the judge about the gun comments, and of the boyfriend hurting the child. What is going on at the moment with the child? Is your wife trying to see the child? Does the child want to see the mother? Usually the judge will do what THEY think is best until the child is old enough to say what they want

3. Annulment.. I don't know about that. Depends on your evidence and your state laws. Divorce sure.

I beg to differ, her line of argument is that I had mistreated her for 8 years while in Jamaica without acting on this so called mistreatment. within 3 months of arriving and getting married she flew the coup so to speak and when she realized she did not have her status adjusted she began a long range of things including soliciting ME to continue in a fraudulent relationship until she has her status which I did not agree to thus the VAWA deal. but with that said are you saying she will be allowed to stay?

1 there are 2 police reports..the first incident list ME as the victim and she as the suspect nearly identical to the 2nd arresting report/situation. I have pleaded NOT guilty and intent to fight it. her word against mine >> credibility being the deciding factor ( I would think). If I win she loses. If I lose?? what then. Its the first and only incident ever in my life and I even will have my ex wife submit a character reference to the effect that well, that simply is not me ( and its not)! How do I start a case with ICE? just call them tomorrow?

2. presently she is living with her "friend", no job no licenses ,no money and of course an status thats undecided. so how would any judge on earth rish putting a child into such a position. what if her friend decides to put her out..?

3. annulment would be best of course but My lawyer filed a dual case. annulment but if not then divorce..all in one bundle.

the solicitation, by itself, is enough grounds for fraud with ICE.

You've got it documented, so

you need to prepare a thorough casefile of evidence, to present to the entities I mentioned prior.

Sorry to hear bruh I think you allowed her to control you from the start - telling you when to divorce ya wife and "file" for her...!

I dont see where she will be able to get an approved case for VAWA it is more than calling the cops - she's a manic.. was clear from the said behavior above. Cant Answer the custody issue... if she is able to care for him too why not..? It is hard to get an annulment since you all had sex prior to marriage... though it ("marriage") was not consummated. If she entered the marriage under fraudulent reasons then you may qualify.
