Disappointing news...I called USCIS today just to see how things were going... I talked to an officer and was inquiring about the 5 month abjudication time line... He told me that it will take 6-7 months minimum to acquire the NAO2..He said the web site shows 5 mos because people have a tendancy to believe what they read..It gives USCIS a bit of breathing room to string along the customers.. He did say that after 4 months to start pestering your State representitives.. The CSC fiasco threw everything into chaos and It will take a year to get back to an efficient manner of processing the CR1...

I am not sure how to react to what he said because at the moment I am in disbelief.. But I don't think the VJ timlines can be that far off... Everyday I lose 3 days lol... Right now I am at a 7 month abjudication...I was going to wait until 5 months before I wrote to my State Representitives but know I think I will contact them at 4 months..

I hope this officer from USCIS is wrong but he seemed knowledgeable and up front and honest..

I just hit 3 months so now comes crunch time.........

I wonder if we have any legal recourse...

Legal recourse for what? They never promised you to have it done on a certain date.

That was true,they take more than 5 months.if you get approved in lees than 5. then i would call that a LUCK. :thumbs:

09/10 - Wedding

09/31/10:came back to states.

10/25/10: I-130 package mailed.

11/10/10: NOA1 recieved(I130)

11/16/10: Touched.

11/18/10: I129F package mailed.

12/02/10: NOA1 recieved(I129F)

12/31/10:Touched.

I am curious as to this "officer's" words. Transfers from place to place happens within the system from time to time. I also am curious as to why he would recommend contacting congressional help at 4 months when there is really nothing they can do until 6 months (at least that is my understanding). As for legal recourse...the others are correct...no promises were ever made. Good luck and throw your calendar away...days pass to weeks and on to months. It will happen soon.

calm down and relax..i think it's a case to case basis and it's all about your luck..just pray and everything will be ok..

5 months is when government representitives are to be contacted.. They tell you this on their web site...I have no idea where you got 6 months...

My wife and I are a few days from 9 month's since NOA1. My Senator is involved. Last letter I recieved from him 1/15/2011 had a message attached from USCIS. It said wait a decision will be given withing the next 90 days case needs further investigation never have recieved any RFE's. That means 10 month's from NOA1. Just returned from spending a month with my wife and family in China. It did help in relieving the stress somewhat. Trying to remain positive thru this. Some are lucky and other's like my wife and I aren't. Wishing all the best this year.

5 months is when government representitives are to be contacted.. They tell you this on their web site...I have no idea where you got 6 months...

6 months was from the attorney who handled our case. It allows a small overlap and doesn't necessarily bog down a case. So I can had the reference to my list of sites to quote, what web site are you referring to (link please) that says to contact congressional assistance at 5 months. Thanks for your help.

Did anyone give a reason to why this long?? That is beyond being realistic..

Ill check when I get home... I think was Patty Murrays website .. but i'll double check..Someone had posted the link in a prior topic on the USCIS Service Center Forum...They had immigration rules and regs and procedure's to follow if you were having issues with USCIS

I always have been told it doesn't help to get your state senators/representatives involved? In your case it seemed to help... At what point did you contact them? I wonder if its even worth a shot for me being that I'm in Wisconsin and 1/2 of our senators are off on strike in a different state... :( ugh!

Before you read this at no time during these 9 month's have I ever recieved any RFE's.

Letter states;

The officer has stated we cannot move forward on the case until all unresolved issues/reviews are complete.

We cannot move forward on this case at this time as there are unresolved issues. A required thorough review must be done before a decision can be rendered. Unfortunately, we cannot speculate as to when this review process will be completed.

We realize that your constituent may feel frustrated by delays related to his or her case. USCIS must weigh individual inconvenience against the broader concerns of public safety and national security. The USCIS is committed to adjudicating immigration benifits in a timely, efficient manner that insures public safety and national concerns.

It is hard for me to believe this #######. April 29th we will have been married 3 years. My wife is not a terrorist or a member of the communist party in China. Wish I could find a good civil rights or human rights lawyer that would handle this pro-bono. This is a insult to me and my wife and our rights as humans. Many will fire back at me saying relax, calm down and be patient. March 9 it will be 9 month's since NOA1. My patience is gone with this #######. Ready to just give up and move to China.
