Voluntarily left the US but want to go back

Timeline

My Husband and I did everything by the book. We applied for a K1 Visa, was approved without issue. Entered November 7th at Lewiston POE - no problems, married November 26th with both families present. I went through a bout of homesickness and desperately wanted to go back to Canada. So my Dad came to pick me up and I went back. It's been 4 days and I miss my Husband terribly. He's hurt that I left but misses me as well and we're looking into steps to prevent the homesickness and work through some issues.

Yes, we should have examined these things prior to me getting the not so brilliant idea to leave voluntarily. Yes, I'm an idiot for not researching other avenues to handle the stress. I get it.

But where do we go from here? Can anyone point us in the right direction?

Our Timeline:

11/26/1992 - Met in NYC (Drum & Bugle Corps) and dated for 2yrs

11/30/2009 - Reunited after 15yrs - Feb19 got engaged!

01/13/2010 - Visit to US and got Engaged (Home on Feb19)

02/22/2010 - Sent I-129F overnight USPS

02/23/2010 - Arrived at VSC, signed by D RENAUD

03/03/2010 - Received NOA1 Hardcopy

03/20/2010 - Visit to US for the summer

06/11/2010 - Received NOA2 Hardcopy (109 days)

06/28/2010 - Received Packet3

07/12/2010 - Sent Packet3 overnight to Montreal US Embassy

09/13/2010 - Packet4 received (61 days)

10/05/2010 - Medical in Toronto

10/26/2010 - Interview - APPROVED!

11/07/2010 - POE Lewiston

11/26/2010 - Married in New Jersey

Theres no waiver or anything you can file. ( Not sure if you just posted in the wrong section)

You will have to start over with filing and paying for CR-1 go through the whole process again, takes about a year.

Your interview took 67 days from your I-129F NOA1 date.

So is the option of him moving to Canada available? Not sure, but maybe that would be easier. I hear ya on the home sick. My poor sweetie I really had some bad days..weeks for that matter. I volunteered at the local hospital so I could at least get out and start meeting people. I finally was able to go to work and started a part-time job that is allowing me to meet new people. Its not easy. I though about going home several times. Hope it all works out for you both.

It is bad, yet no as bad as you may think.

See, had you stayed in the United States, you would have now to file for AOS, which costs $1,070 and takes 6 months or more. Now you file for a CR-1 instead, save money, and eventually will enter the US as a lawful permanent resident and receive your Green Card in the mail. While waiting for the CR-1 to be processed, you can still visit hubby for up to 6 months at a time.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. He has always talked about one day wanting to live up here, but he's a career military man in the US Army. He has another 3.5yrs to go before retirement. So he's not able to move up here. In fact, this June he is being transfered out of Maryland, so we don't know where he's going. I had my medical and embassy interview in Oct 2010. Is USCIS really going to make me pay to file the same paperwork we JUST submitted? Am I really going to have to pay another $275 to take another medical just to have the same results? Do I really need to go back to Montreal for ANOTHER interview? *facepalm* I really screwed up huh :(

Sorry to say it but, yes..sad.gif Had you already filed for AOS from the K-1 (the $1070)? If so, that is unfortunately lost...

In short...yes

All the procedures (medical, interview, paperwork) needs to be done all over again. Plus all those fees again. Nothing can 'carry over' from your K-1. It ALL needs to be done again...sadly that includes the waiting too

That sucks, I feel for you. I get bouts of homesickness too, I've been here for 3 weeks. But there is no way I am visiting home without the GC. File the CR1 right away! All is not lost. Since he is in the military there might be a chance you can get it expedited.. Hopefully you can be with him before the end of the year! You can visit each other in between.. When you come back to the US, you'll get a GC right away, and you'd have learned your lesson and perhaps the time apart will make your relationship stronger. You made a mistake, but let's not dwell on it, there are always solutions! I wish you luck and hope that CR1 process will be smooth and quick!

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)
