US EMBASSY IN IRELAND OR PAKISTAN

I file the petition I 130 for my spouse who is citizen of pakistan and a student in ireland.

we got married in pakistan and same time i filed I 130 with the present address of pakistan for him when we were there for only 3 months to get merry.

now he is back to ireland and i am to US.

he renew his student visa every year.

i wants to know which Embassy he will have his interview?

i am really confused because what if it is in pakistan and he is in ireland then he have to go to pakistan and what if they keep the passport for a while and then give final decission

or

if its in ireland what if he dont have visa of ireland at that time because he renew every year.

Pakistan.

You married there, and is country of residence as well as nationality. Going to school in a different country does not convey residency to the college student.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

havin student visa is not legal residency? he is legal there

They have legal status as far as visiting legally, however residency tends to allow living in a place permanently.

For example a student can visit the USA in a NON-RESIDENT F-1 student visa, they are NOT a resident of the USA, they do not have a resident permit (Green-Card), this tends to be the same no matter which country you go to.

A person visiting a country to go to a school, not a resident, they are an international student visiting.

A student visa is not generally seen as being resident of the country, just studying there temporarily (as the visa will specify you need to leave when you stop attending college). But, the US embassy in Dublin is quite easy going, and asking cannot hurt!
