RFE Please Help - Montreal Consulate

Hi,

The Montreal Consulate received our case last week from NVC. They have sent to me (the U.S. petitioner) in the mail a RFE letter asking for the benefciary's Proof of Canadian Citizenship or her legal immigration status. She is a permanent resident of Canada. For whatever reason I did not include that in the I-129F packet. I never saw instructions to do so. I was thinking they would ask that with Packet 3. We haven't received packet three yet though. The letter says "please furnish this office" with the evidence. The letter is from their office in Champlain NY.

So I sent them an email to montreal-iv-dv@state.gov with a color copy of the front and back of her resident card and a scan of the letter they sent to me. I was also thinking to snail mail and fax them this information. However I received an email back that says:

1. If you have been asked to provide additional documents, please send all the required documents together. Sending documents separately will not allow the IV unit to complete processing of your case. When you have all of the required documents, please mail them together with your name, case number, mailing address and email address to our office using the CSC Visa Information Services <http://canada.usvisa-info.com/> . Please visit http://canada.usvisa-info.com/ to register for a DHL courier location to drop-off your documents. Upon receipt of all the required documents, the IV unit will review your file. In rare instances, you may be required to return to Montreal for a follow-up interview. If the visa is approved, the IV unit will send the completed visa packet to you via the DHL courier services to the courier location you have previously registered for. Please allow six to eight weeks from the time you send correspondence to receive a reply from the Consulate. Please note the IV unit is not able to confirm receipt of documents. Documents received at the IV unit are processed in the order in which they are received.

NOTE: our P.O. Box 65 at Stations Desjardins is no longer in service. Mail sent to this address as well as the mail sent to our office address will be returned to the sender.

Please- what do I do? Is DHL the only way to send them the document they need? So does my fiance have to send these copies of her pemanent resident card through DHL from Canada? Is it a problem to fax or email this to them? Why would it be, they are not originals, we can't send them her card, just copies.

DHL will be the fastest way for them to get the information that they requested. It should only take a few days for it to arrive. Make sure that you put your case number on the envelope and on the information that they requested. Maybe even a cover letter for easier reference for them. Anytime I have emailed Montreal consulate I have only received the automated response.

Ok thanks. We will send DHL, and maybe fax as well. However I have read that Montreal is WAY behind in processing RFE responses. Anyone know if that is still the true?

Jeannie L- should we send through CSC visa services <http://canada.usvisa-info.com/ registered DHL website or direct through DHL?

The letter states:

Thank you for your communication regarding the below-referenced immigrant visa case. The following check marks pertain to your case.

X 1) Please furnish this office with proof of your Canadian Citizenship or your legal immigration status in Canada.

U.S. Consulate General Montreal

I never saw any instructions anywhere to send the beneficiary's Proof of Citizenship or Residence. Is this an offical "RFE" that should have been included before and will delay our process, or is it something they are asking for while we are waiting for Packet 3?

When you go to the CSC Visa information there is a form for you to submit when you are sending documents to the consulate, Print the form and take it with you to the DHL location nearest her or you. On the left hand side click on Courier information....Then scroll down to the heading Sending documents to the Consular Section.

Me again. Thanks for your help so far. Just one more question.

The form to give to DHL asks for a Reference ID- which is supposedly displayed on the Applicant summary page http://usvisa-info.com. I don't have an account on that website. Do I need this Reference ID? If I do, should I or my fiance create an account and get this Reference ID? It seems like that everything about DHL courier is for appointments, while we are just trying to send an RFE document.

I am in the U.S. and my fiance is in Canada. I am the applicant.

When I log into the CSC site there is a reference id number. You will have to register with DHL in order to get the reference number as far as I can tell.

Hi There,

I know it's been a year, but if you can see this, I was wondering if you could go into more detail about what you did after the RFE? My fiance, who is a Canadian resident (french nationality) was also issued the same RFE. Also, keep in mind, DOS told us that packet 3 was sent out a few weeks ago (haven't received it). We sent his proof of residency today, but we're not sure if we should wait for any kind of response before sending packet 3. We're not sure if we have to wait, so we're planning to wait a few days and send out our packet 3 at the end of the week.

I'm curious to know if you did the same thing? Or perhaps they sent packet 3 after they received your RFE? It's just strange because according to DOS, packet 3 was sent a few weeks before the RFE. I thought it would be reversed.

Any advice is greatly appreciated.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
