Hello everyone: I just checked the NVC AVR and it said, "documents missing or incomplete from packet of forms". I am wondering if that is the false RFE that some had gotten. It also said that a letter had been mailed out on March 18, 2011. No letter yet in my mailbox. I will call NVC tomorrow morning.

Personal Info:

flew to Indonesia in Feb. 2010 for 2 weeks

back to Jakarta on June 15 to prepare for:

Marriage on July 4, 2010 in Semarang, Java

What was the expedite request if you don't mind?

I don't mind.... here is my email to them. Honestly, I don't think the "active duty military" portion played much of a role in the approval because they never asked for proof. I would try using #2 or #3.

NVC Case Number: RDJ2011XXXXXX

USICS Case Number: WACXXXXXXXXXX

Petitioner: My Name

Petitioner DOB: My DOB

Beneficiary/Applicant: Her Name

Beneficiary/Applicant DOB: Her DOB

Dear Sir/Madam:

I am writing you to request an expedite of our I-130 petition through NVC. I have three situations that I believe could possibly qualify us for expedite.

1. I am active duty military; due to the delay at USCIS, the normal NVC processing times, and the 4-7 month processing time at the Consulate in Brazil, by the time my wife arrives in the US it would put me extremely close to my deployment time frame. Not to mention, with the current tensions and tragedies throughout the world, I could be called upon to deploy sooner than expected. My wife knows no one in the US and if I were to deploy (for 8+ months) immediately following her arrival, this would put her in a extremely difficult situation. What would she do, how would she get around, how would she get to work/school, etc? Due to my military service, I move every 3 years and do not have family nearby to assist her. The sooner she gets here, the sooner we can start preparing for my deployment (license, work/school, meeting people, etc.). I can't imagine being away from my spouse for over a year, arriving to a new country (to spend the rest of my life with someone), and then they leave for deployment.

2. Financial Hardship: I personally don't have many bills but, since we filed our petition (August 2010), my wife's employment status and living arrangements have changed. With that being said, not only am I paying for her living expenses and education but, now I'm also paying a portion of her rent. I live in California (where the price of housing is ridiculously high) and I'm also sending her anywhere between $750 to $1000 every month, which is starting to put me in a financial bind. It's getting to the point where not only am I not able to save money... I'm actually having to dip into our "Immigration" savings account to make ends meet.

3. USCIS Error #1. I filed our I-130 in early August 2010. It was transferred from CSC to TSC to speed up processing but, due to "a number of unforeseen circumstances" at TSC, they went beyond their normal processing times and were subsequently returned back to CSC for processing. According to one of the USCIS "alerts", NVC was briefed about this and would assist in approving our cases as soon as possible. Here is the LINK. Shortly after our petition was sent to TSC, I received a notice that our application had been sent to NVC but returned to USCIS for "review". I knew this was an error because I never received a notice of approval or anything stating that our petition was sent to NVC. It took me two months to get them to investigate and correct this error. According to the USCIS Ombudsman, USCIS (TSC) inadvertently entered an incorrect code into their electronic system. Even though I had an approved expedite, my petition was at a standstill until this "electronic error" could be corrected. It just so happens that the error was corrected when our case was transferred back to CSC.

Thank you in advance for taking our petition under consideration.

Sincerely,

My Name

Chief Petty Officer

United States Navy

Just received email from NVC 1/2 hour ago (12:15 am - 03/23/11) stating that they were missing DS-230 packet. My certified letter tracking shows that they received the IV packet on March 16 at 7:30 am. So will wait for log in of packet before I get too worried about it.

Well-deserved. I actually honestly believe that petitions from those in the military service should be expedited. You guys serve this country better than most guys in the USCIS!
