Hi, I was wondering if K1 beneficiaries in Argentina who are currently going through the process and those who already went through it could share about the experience of what and how the process is like in this country.

I may be wrong but there´s not much detailed information about it.

I for instance would like to now about the medical proceidure: what`s it about and how long does it take (since I live in another city).

I also have doubts about the police certificate: can I request it at the "institution branch" (is this the right term? ) where I live or do I have to go all the way to Buenos Aires to get it?

Maybe we can make a post for K1 people in Argentina?

I suggest you read posts by Argentina members, which you can find by going through the posts from the "Portal" page, and read reviews of the embassy on their VisaJourney page. This will give you a good sense of issues local to Bs As. If you have specific questions, feel free to ask them, either on the regional boards or the K-1 board, depending on what the question pertains to.

The medical exam is an appointment with a doctor the embassy works with, who will physically examine and test for various things, just like any other doctor, and fill out some paperwork for the visa process which you turn in to the embassy. It should take a few hours.

The police certificate, I'm not sure if you can get it in other cities, we went to Buenos Aires because we are near there. You'll have to ask at your local office.. remember to ask for it with exception to article 53. They won't take it if you don't do this and you'll have to get a new one.

About the medical: will I get the results the same day?

I´m not sure if that´s what you meant by saying that only takes a few hours. I´d really like to know because like I said, I will have to travel to Buenos Aires... and I read that they make blood tests and chest x-rays, and people have to go again to pick up the results (hope not).

About the police certificate, for how long is it valid? and do they take long to issue it?

Hi,

You can get your police record in other cities. My husband got his in Salta. The only thing is that he had to go twice because the first one had expired. You have to make sure its within 6 months of the interview. He went just before we applied.....then we had to wait longer than 6 months, so he had to go again. Both times were in Salta though.

As for the medical, there are 4-5 doctors listed on the BA Embassy site. He went to the one with the last name of Kelly. Kelly was the only one that had an appointment for the next day. He had to go all the way to BA(24 hour bus ride) for the medical and for the interview. Once we sent in the medical packet along with all the other items required for packet 3, the embassy contacted us within 4 days with a date for the interview. The interview was scheduled for 3.5 weeks later.

We have written quite a bit about the process in Argentina, so just have a look.

I would like to know if once the Embassy got your case, did they sent you the "instructions packet" right away?

Or did you have to get in touch with them?? If so how did you comunicate with them? Did you email or call them?

In some countries you have to wait for them to sen you the packet with the instructions, but with others you have to call and email them all the time.

I am from Argentina and of course I will follow my case till the end, but I just want to know how to comunicate with the embassy in Argentina once they get the case from NVC.

I have one more question

Did you send them your medical packet in the packet 3 or a copy of the medical packet?

I am asking because i read in the website from the Embassy in Argentina, that u have to send them copies of everything they require for packet 3, and you take the originals with you to the Interview.

Now that u are saying you sent them the medical exam before the interview.. I am confused

My name is Andy, I met my fiancee three and a half years ago here in Mpls. Her name is Sole, She is from Argentina and she was here on a J1 visa as an Au pair. We met while she had about six months left on her visa, and before we knew it we were in love.

It soon dawned on us that she was here on a temporary visa and we would have to make a decision. we couldn't stand the thought of loosing the best thing that has ever happened to us. Getting married was one option, and now i wish we would have, but at the time It didn't feel like it would have been for the right reasons. We asked our selves would we be getting married right now if it wasn't for the immigration issue? The answer was no. We were not ready. I thought we were doing the responsible thing. So the way we saw it, we had two options. She could leave or she could stay, and our relationship was too young to let her go back home and make the transition to a long distance relationship. We were convinced that it was not a big deal for her to overstay her visa as long as she was not breaking the law in any other way. We were unaware of the consequences and blinded by our love. After about 14 months of overstaying she voluntarily returned to her family in Argentina on 12/6/08.

We talked every day while we were apart (thank God for Skype). I worked and saved my money for nine months until I finally had enough money to sustain us for a while. I quit my job and went to visit her. we traveled around south America for seven months before I ran out of money and was forced to return home. Before I left, I proposed to her and we were more motivated than ever to spend the rest of our lives together.

I started the petition for the K1 visa as soon as I got home. five months later the petition was approved and everything seemed to be going well, however recently we have been preparing the papers for the visa application and the hard questions came up about visa overstays. and now after everything when we were seemingly so close to being together again, we are being told that it is not even worth finishing the application because it will be denied, and that she is barred from the U.S. for a total of ten years! I have never felt so helpless and broken in my entire life, this country is suppose to be about freedom. and now because of something so harmless, I will be pushed out of my own country for the next eight years in order to marry the only woman in this world for me, the woman I love. There must be something I can do. Appeals, wavers, some kind of exceptions. Please help us. We are desperate.

I am sorry to hear that!! I was in au-pair too and i met my fiance while i was in USA, I also overstayed my visa, but was only for 1 day.. I was worried about getting denied because of that but i found out that you have a 3 years bar if you overstaed for more than 180 days and a 10 years bar if you overstay for more than 1 year.

I see that ur fiance has overstayed for more than one year!! so what i read is that she will have to go to the interview, she will get denied and there is when you apply for the I-160 waiver

Hi Eliana,

Perhaps Rugby7 has already answered.. but the embassy will contact you with packet 3 instructions, they will send you them over email, however for us it was a delay of several weeks from after the packet left the NVC so I would suggest getting that packet ready as best you can now instead of waiting for them, then once you get the email confirm you have everything they ask you for and submit it right away. All communication with the embassy that is not in-person will be through email (except when they mail you the actual visa); they don't even have a phone line apparently.

About the medical.. what happened to us was that we submitted packet 3 without medical, then got an RFE from the embassy asking for a copy of the outside of the sealed envelope they give you at the doctor. They would not give us an interview date until we submitted that, evidently they considered it part of packet 3.. because of this I suggest to others to have the medical exam and submit this if you can with the rest of packet 3 so you can have the interview sooner than we did.

Hola! yo de nuevo con mas consultas!

Ahora estoy leyendo el Packet 3 (todavia no llegaron mis papeles a NVC pero como para ir adelantando...) y veo que piden "certificado de buena conducta" y aparte el "certificado de antecedentes penales". Son lo mismo? yo saque el de ant. pen. en la policia federal, pero no se si el de buena conducta tambien lo necesito, o si esta incluido en el de antec. pen.??? Viajo a Bs. As. a legalizar los papeles el martes que viene y quiero estar segura que los tengo todos completos!
