Hello VISA family, I recv'd the VISA Bill for my husband on yesterday. The origainal IV bill is $404, however my step-son is coming to, so I e-mailed the NVC to let thme know they need to add him as well,he is five years old. When I did the original i-130 it stated that the minor children that will be immigrating with their parents doesn't need to be on the the primary applicants 1-130..... so, do I send the extra $404 or should I wait for the nvc to insrtuct me?

My minor children are immigrating with me as well and we had to fill out separate I-130's for each of them. I'm pretty certain they have to go thru the whole USCIS process as well. We had to submit all the certificates etc for them just the same way as for my case.

USCIS

21.5.10 - NOA1

17.11.10 - NOA2 (there was a hold up due to incorrect information put on forms by our lawyer)

NVC

16.12.10 - All fees paid and everything received at NVC

05.1.11 - SIF and CC for my case only. Get RFE for my 2 sons as lawyer made ANOTHER mistake and made errors on I-864's for the children.

10.1.11 - Corrected I-864's received at NVC via Fedex

14.11.11 - Corrected paperwork entered on system according to AVR

17.1.11 - Medicals done

27.1.11 - My husband calls his senator's office and asks for help to get things moving.

31.1.11 - Finally got SIF for my sons!

01.2.11 - CC (Phoned DOS as NVC shut due to weather and they told me paperwork was completed at NVC on 1st Feb)

10.2.11 - Interview date assigned

15.3.11 - Interview - APPROVED!!!

24.3.11 - POE - Dallas, TX

read page # 1 of the instruction of the I-130 on "who may file this form" section 1. It does say that a separate form is requested for certain family members.

To correct it you will need to file form I-130 for the immediate relative. Emailing the NVC will not help if they received no post approval from USCIS as they process information received from USCIS.

Policy changes all the time so you can await the response (7-10 days) from the NVC or Call them tomorrow and get a fast response. You can pay the 404 for your husband and see if the " Following to Join" status would be applied/given by the NVC as a COURTESY even though the child is not a derivative.

Please update us when you get a response.

Thanks Ricardo , as I said too someone else, I filed the old way( k-3)... But thevi-130 was approved first, and the k-3 is dead, but when I did the I-130 and i129 I added the child, but it does not apply now... Am so upset, so I think we will just hv to wait. Because I hv to file a whole new i130. +a new fee of &420, when I filed it was 355.... Mad , mad

Exactly.... the 1-130 was approved first,so that automatically killed the 1-129f, so now I have to file the 1-130 for the child. My husband's paperwork is already@ the NVC level.

I think there is a way to apply for an expedite for the childs I-130, I just don't know how.

Let me see if I can find the thread I read it in.

Let's see if Darnell will stop by here, I think that's the person I saw posting something about a possible expedite.

I copied this from the thread where it was discussed.

"Now you have to file new I-130 for the child.

You can get some expedite done when you file the new I-130, though, if you reference

'EXPEDITE, APPROVED I-130 Petition for Mother, USCIS # XXX-2010xx0032' in:

1. the coverletter

2. the top page of the I-130

3. the top page of the G-325

4. the outside of the envelope (omit case #)

and write that 'expedite' phrase in red ink, for 2,3,4.
