Oh word? that's longer than I was expecting - but looking at the information in your sig it's a lot more other stuff that goes on than the 5 months process time they show on the USCIS website for Vermont Service Center...

Hey should I start a new topic or can I ask other questions here?

Does this thing have an instant messenger or anything?

heheheh you can ask the question here if you would like... But allow me to say USCIS deals with the 5 month thing that you are looking at ... after that the case WILL be transferred to the National Visa Center (NVC)

http://travel.state.gov/visa/immigrants/types/types_1306.html

OK, I see... My mom already has a visa, she comes here all the time. So she can still visit and stuff while this process is going on right?

And I've been reading about adjustments and stuff if the person is in the country. I wasn't sure about that though so I just filed the I-130 instead of going on some unknown adjustment route.

I figure the NVC will be dealing with a different kind of Visa - for her to be a LPR, no? Why does she need a Visa, doesn't she get a GC?

They will definitely come when they wake up

Yes. Your mom can still travel will be no issues.

The adjustment packet only applies if she would be in the country (valid status)

The case will go exactly like this .. USCIS>NVC>US. CONSULATE IN KINGSTON,JAMAICA> Entry Port from Jamaica to USA (hand carry documents) > Handover packet then they will send the information to USCIS where they will issue the GreenCard.

Yes when you get to the NVC in say 5-6 months you will make 2 payments 1st $88.00 for the Affidavit of Support Review .. 2nd $404 for the immigrant visa after that she will make 2 more payments 3rd to medial facility for the medical interview and 4th payment for the delivery of the visa after an approved interview in Jamaica.

You asked why would she be issued a visa when she will get a greencard to be considered to a LPR - good question. So what will happen on the day of the interview when approved... they WILL cancel her NON-IMMIGRANT Visa (B1/B2) why? Well that visa are for use by those travelers who will enter the USA as a VISITOR. Your mom would not be considered a non-immigrant but a immigrant to the U.S. (migrating to live permanently) when she enters the USA she WILL be processed for her greencard and its say she is travelling New york and will fly into JFK when she is ADMITTED in the USA she will be admitted as LPR not as a visitor. She will receive her greencard in the mail about 3-8 weeks after she arrives.

This is great information man. I'm glad to get it from somebody who has already completed the exact process!

To bug you again:

My little brother is 18 and unmarried and in school, so i figured I'd let my mom file for him (my bro) and possibly her husband (my step-dad) when she becomes a LPR.

Do you know how long that will take, for her (when she is a LPR) to bring her son here as a LPR (he currently visits as well). He will be 19 on 10/07/2011 - but I know that under 21 is considered minor, from what I've been reading.

It's a better route to take than for me to file for him right? I think I've come to the understanding that USC petitions for siblings are a pretty slow road.

Thanks again all who may respond.

This is great information man. I'm glad to get it from somebody who has already completed the exact process!

To bug you again: you're ok

My little brother is 18 and unmarried and in school, so i figured I'd let my mom file for him (my bro) and possibly her husband (my step-dad) when she becomes a LPR.

YES let your mom file for him because if you do he's looking at 11 years. HONESTLY with the current processing times for F2B it would take him 8 years to get here based on your mom's petition .. When your mom petition for him he would be 19-still (F2A- LPR Filing for a child under 21) she can request he processed as a "child" under 21 which someone can tell you about later if he's going to turn 21 and have not entered the usa..!

Do you know how long that will take, for her (when she is a LPR) to bring her son here as a LPR (he currently visits as well). He will be 19 on 10/07/2011 - but I know that under 21 is considered minor, from what I've been reading.

you're loooking at 3 years... BUT in 4-6 months that might drop to a year you'll never know so when it's time for your mom to file you should watch the visa bulletin

http://travel.state.gov/visa/bulletin/bulletin_5228.html

It's a better route to take than for me to file for him right? I think I've come to the understanding that USC petitions for siblings are a pretty slow road.

yes

Thanks again all who may respond.

i'm not quoting you it's a way to show my responses better

was your mom/ step father married before you were 18...................................................................?!

- Yes, they got married when I was 6 years old. I lived with mom, step-dad and my little brother until I was 17, when my biological father, a USC, filed for me and I moved here.

YES let your mom file for him because if you do he's looking at 11 years. HONESTLY with the current processing times for F2B it would take him 8 years to get here based on your mom's petition .. - OK that's how I understood it as well - it's pretty outrageous timing for a sibling but w/e..........My bro is still in high school though, and will finish 6th form in summer or 2012, and if he's not here by then, he'll go to University - so there's no rush, I just wanted to know the processing time, when it does happen.

you're loooking at 3 years... BUT in 4-6 months that might drop to a year you'll never know so when it's time for your mom to file you should watch the visa bulletin

http://travel.state.gov/visa/bulletin/bulletin_5228.html

- Um yea...as it turns out, that bulletin is pretty confusing to me. I don't get it. A lot of the terminology they use and references they make are not familiar to me. I guess as I go further into this I will find out more. The only thing I really grasp from it was that they apparently have less visas than applications so everybody who applied at some point (not sure when because there were a lot of different dates) will not be getting the visa..??? idk
