like if you take money out of your 401-k you will receive a 1099 form to file your income taxes,if the bank takes out intrest at the end of the year they send you a 1099,it needs to be filed with the 1040 tax

My interview is next month and I do not have my w2's for 2010.My employer is away from U.S for 3 months. I do not know what to do.I heard I can use 1099. Do I have to file both 1040 and 1099 or just one.What about 1099 MISC. Is this ok to file this?Please explain a little more for me.

What types of 1099 is required?

A tax return would include any 1099 forms you received for the year. Remember that 1099 forms instead of W2 forms indicate self employment, not "employment". A 1099 for interest payments or unemployment is simply "income".

So is this OK to only show 1099 during interview for income? or it must be 1040 or w2's?

Not if you expect to receive a visa. They 1099 you must be talking about is part of a tax return for a self employed person. The self employed are required to submit a complete tax return or tax return transcript with the I-134.

You seem to be a little confused. You don't fill out your own 1099's, just like you don't fill out your own W2's. A 1099 is provided to you by anyone who gave you money during the year, other than wages from employment, and they intend to declare those payments on their own taxes. A bank will send you a 1099 for interest they paid to you over the course of the year. A stock broker would send you a 1099 for any stock sales you made. Someone would send you a 1099 if you did non-employee work for them (self-employed or contractor). If you receive 1099's from anyone then you need to include the income from the 1099's on your tax return.

Your employer is required by law to send your W2's before the end of January.

W2's and 1099's mean nothing without a corresponding tax return filed with the IRS.

I was making two points. First, she can't write up her own 1099's. Second, her employer is required to send her W2's by the end of January, even if her employer is out of the country. If she's got a job where she should be receiving W2's then somebody should be handling the W2's while the employer is away.

I didn't get that she was intending to do her own 1099 forms. Even so, I was agreeing with you and adding information to the discussion.

Moving this to Consulate/Embassy forum.

I-134 is not filed with I-129F it is brought to the interview.

You may or may not have any 1099, I get one reporting income from being a contractor for an internet business.
