disappointed in our K3 application

wondering what is really the advantages of applying this K3 application. They said that to shortened the time of being apart to their love ones while the I130F waiting to be approve. But the q's is where is the proof? applying K3 is not far away the way the I130F processed...exhausted. the same time frame.You need to watch all the touches they made time to time..and yet they still advise you to wait for another 60days in some cases..wow! unbelievable! If this K3 application is the option for all I130F filers hope they make this a REAL option and the word "SHORTENED" hope they mean it coz i dont see any possibility in my case to shortened my waiting time to this K3..right now I'd rather wait to my I130F than putting in mind this K3 application will be the answer to not to wait too long to be with my hubby. I know some people out there have the same cases, they applied K3 while waiting for their I130F to approve and yet still waiting for their K3.ugh!

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

The current status of the K3 visa process.

At this time, K3 visa processing has become more unpredictable because the National Visa Center (NVC) will no longer process I-129f petitions for K3 visas if the underlying I-130 petition arrives before, or with, the I-129f. It is a credit to the United States Citizenship and Immigration Service's (USCIS) efficiency that they are processing I-129f applications as well as I-130 applications in a quick and efficient manner.

The United States National Visa Center has stated that their personnel will "administratively close" aforementioned I-129f petitions

Touches don't mean anything.

Your petition was given a bar code when it was received by USCIS. This bar code is swiped everytime someone handles your petition. Handling your petition could mean it was counted, moved to another filing cabinet, or placed on an adjudicators desk. The problem is, when your petition is touched, you don't know if it was given to an adjudicator or moved from filing cabinet A to filing cabinet B due to a leaky pipe

When you register for updates on the USCIS website there is a 'last updated' date on there, when that date changes, there's your touch

Hey Rie -

You're probably dealing with a common problem

of

dealing with 'old information' on the K-3 visa. You've read something, but no one stepped up to remind you that the info is old, outdated.

For the last 3 years - the I-130 and I-129F were approved together at USCIS

Prior to that, it could take up the 3 years for an I-130 to be approved, so the I-129F filing for a subsequent K-3 visa made a lot of sense to ppl, for the TIMING, but - not really for the monies, as is an entire new AOS packet to file once yer stateside if a K-3 visa holder.

Since Feb 1, 2010, the I-129F is administratively closed at NVC, as the I-129F and I-130, approved together, travel together into NVC, and the 'need' for the K-3 is gone.

The visa process is completed by two different organizations, the USCIS and the Department of State (DOS). USCIS does the original approving of the visa petition. Once the petition is approved it is sent to the National Visa Center (NVC) and then to the US Embassy which are both under the DOS. If your visa is approved and granted, when you enter the US the USCIS is in control again. The USCIS issues Green Cards, Work permits, Advance Parole, etc.

In short, you must get the visa petition approved by the USCIS and then the Visa approved and issued by the DOS. Getting these two parties to work together is like getting Democrats and Republicans to work together for the greater good of the people.

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

Wow, I am shocked on what I have read in this thread. I applied for my husband I-130 & I-129F. They were approved the same day, i believe on Oct 28, 2009. I went ahead with the K3 route & my husband recieved his interview on April 24th, 2010. He was put on administrative processing since meaning we are almost hitting a whole year from that day. Do you think its because the K3visa is 'administratively closed' because I believe i heard these rumors also. I hope Im not wasting my time on this K3 and they end up telling denying my husband and making us finish the I-130 which will take months maybe even another year until we finish. :angry:

Based on your post, I'm guessing the K3 went through the NVC before the policy of administratively closing a I-129F for K3 when an I-130 was approved was implemented by the NVC. If I'm correct, then that policy would have nothing to do with your case as it had already gone to the Embassy.

No, your delay has nothing to do with the "administratively closed" issue. Your I-129F cleared NVC prior to February 1, 2010. Your delay is because your husband is coming from Yemen. You could hedge your bets and continue NOW with the I-130. If it arrives at the Consulate prior to K3 visa issue, they will issue the CR1 or IR1 instead and save you time and money after his arrival.
