I know that the income must meet 125% of the poverty line and for me at 2 people that would be $18,212.50. I am a veteran and am using the post 9/11 GI Bill for school. With the money I get from school and disability I get from VA, it adds up to be above that requirement. Does the money from my gi bill qualify as income?

I don't think so. "Income" will appear on line 22 of a 1040 form or as "adjusted gross income" on a 1040EZ. If your disability income is high enough on it's own, that's all you need.

Moving this to NVC forum, income comes into play when you send the I-864 to NVC.

I receive a VA disability also and it is income although it's not taxed and never has to be entered on a tax form. The GI Bill income is a bit tricky but I do believe it is considered income though it's tax free (I went to college on the GI bill years ago). You may wish to call the VA 800 number and as an agent there how those funds are counted.

Thanks for the replies guys. I just talked with USCIS and they told me that the money from the GI Bill DOES count toward income. They told me any money I receive counts as income and can be noted on the affidavit of support.

The money from the Bill going directly to the school for tuition and fees may not be considered. Just as when a person receives financial aid the amount used for tuition cannot be considered as income for the affidavit of support.

You may want to make sure by either getting to a tier 2 person if calling USCIS or by making an infopass appointment at the local USCIS office. If you are close it would be rotten if you were given a bad answer by the info line.

I am also a GI Bill student. I was very worried they would not accept it as income on my affidavit of support. I looked all over the internet and could not find a answer.Fortunately my fiancee was approved 10 days ago, and they accepted the BAH from my GI Bill as income!

How did you guys fill the i-864 using the GI-Bill as proof of income. I am a junior in Chemistry and since I started school I have not held an employment so my tax returns have zero income.

Did you write a note and sent the VA letter with the notice of the amount of benefit or did you send the bank account with the direct deposit or both?
