Netherlands Police Certificate

Okay I've posted about this a couple of days ago, but got some more updates on the situation today regarding getting a Netherlands "PC"

This is how it went

Friday 10th -

Received NVC email with the Checklist response letter saying they needed a Police certificate from beneficiary and proof of relationship to household member from the AOS documents (I had sent birth certificates as proof).

I contacted NVC, they told us to call the Consulate in Amsterdam to request a Police certificate, the opperator said it wouldn't delay any of the other documents so I went ahead and mailed off the checklist items, birth certificates needed for the AOS which I had included in the first place, but they must have lost them, and asked for them on the "checklist response letter".

Today 14th -

Husband called Consulate this morning they tell him that he needed to go to the NVC website to read directions on requesting a police certificate (they weren't any help because we already knew what the directions said, but neither the Consulate or the NVC operator seemed to understand?...)

I called the NVC again earlier today as a follow up from Friday and explained to the operator that my husband called the consulate and they said to look up what to do on the NVC website, and she tells me to follow those directions :blink: okay so I tell her I read the directions and it said that we the applicants can't request a police certificate that the NVC needs to email the consulate and request on our behalf. The operator after having me wait a min. told me that a letter needed to be writen to the NVC saying that we called the consulate and to request a police certificate, (which is wierd because here I was talking to the NVC on the phone why do I have to write a letter to them?) I asked the operator if we could email the request,she was like "no", you have to mail it. (but husband had already sent an NVC inquiry email in the morning before I called NVC). She (the operator) wasn't helpful on how to exactly word the letter either and seemed to be annoyed at my confusion, and the phone call left me with a headache.

So they pretty much gave us the run around and left me confused because why would they ask us to request it if we can't in the first place, and I've read that other netherlands applicants haven't had this situation or maybe I read wrong, if anyone can offer any advice or has had this problem any extra info would be helpful. I guess I'll just wing the letter if anyone can offer advice on what to write, thanks.

Also when mailing should I include the Police certificate request letter with the checklist coversheet and checklist or also add the birth certificates again, (even though I mailed the birth certificate copies on saturday and they arrived at NVC on monday, would they be able to sort that out?)

Timeline

They should know the procedure, I would simply print out the page from Travel/State website

Police Records

Available. Police records can only be requested for immigrant visa applicants by the United States Consulate or Embassy where the applicant's case is being processed. Any certificate presented directly by applicants cannot be accepted. To request a police record, the visa processing post should send an email to the Consulate General in Amsterdam at ImmigrantVisasAMS@state.gov. The request must include:

  • Applicant's full name(s) including aliases:
  • Date, city/town and country of birth;
  • Complete address of last residence in The Netherlands.

The Consulate General in Amsterdam may need up to 15 working days to obtain the certificate, provided there is no derogatory information concerning the applicant. If there is derogatory information it may take up to five weeks.

The certificate, which is in the Dutch language, covers criminal investigations only. Criminal records are expunged after a number of years, depending on the offense, following termination of the case (i.e., after service of any prison sentence) provided no other offense is committed in the interim. Police records may, therefore, not constitute a full summary of criminal records. Applicants with a criminal history can obtain their own conviction record from the sentencing court.

These certificates may be used only in processing immigrant visa applications and may not be given to the applicant or to any private individual. The visa applicant may not be informed of the source of any derogatory information contained in the police certificate.

I printed up the page to include with the letter, hopefully they will except it from me the petitioner to save time, since I'm also listed as agent. Should I include the other checklist info again just in case or is it okay if checklist items are split up since I had mailed the birth certificates in with the coversheet a few days ago? How should I handle this?

I would suspect they just want what they requested in RFE.

Well thats the part I'm confused about, They requested two things on the checklist I mailed off the first thing on saturday, but nothing regarding the police certificate because I didn't know I needed to write a letter or anything to send it with the checklist, so do I send both checklist items this time or just the police certificate request letter, with coversheet? As they should have received the other checklist item in the mail, I just want to know if I can do it this way or would it cause NVC confusion??

Ahh, Then yes I would send them copies of added check list items, make note of this on cover letter.
