Can my fiancee bring her daughter on K1 visa?

I was under the impression that I need to have my fiancee K1 visa here in the USA first and then her daughter 2 yrs old to follow at a later date on a K2 visa. Is this the case or can my fiancee bring the child at the same time after she passes her interview and receives her visa? I did of course list the child on my I129f application so USCIS is aware of the child.

They may apply for visas together or the child may follow-to-join.

You can do "follow" or same time. When she gets Packet 3 she will list the child.

Either will work, they can come together (which I imagine is more ideal with such a young child) or she can come later once you are all settled.

as others have stated, the child may come at the same time as the mom or follow to join. based on my experince, overall the process will be simpler and less expensive if the child applys for the visa and comes here at the same time as the mom. also the time spent apart, if you choose follow to join, is time that can never be replaced.

When your fiancee is at the Embassy stage, there is no Packet 3 or Packet 4 anymore. When either of you calls to schedule her interview, the call center agent will ask for her e-mail address. From there she will receive her confirmation letter for the appointment and a link to the US Embassy webpage where she can download the K1 interview preparation instructions in English or Tagalog.

If she and her son will apply for a visa together, she will just need to prepare one set of forms and supporting documents for herself, and one set of forms and supporting documents for her son. The visa fee is $350 per person.

Thanks for the response everyone. I should have ask this question much sooner I just assumed that my fiancee needs to be married to me within the 90 day period after she arrives in USA before the child is allowed to follow.

I hope that it's not to late cuz my fiancee already took her medical at SLEC and is awaiting the 3 month test result will be released Dec. 13 which I hope will be negative.

So I believe that the child must also get the same type of medical exam also? The daugther is only 2 yrs. and since I'm not the birth father will the mother have to get some type of release letter from the father?

Were your wife and the child's father previously married? If yes, then a copy of the annulment papers showing she has custody of the child would be sufficient.

If they were not previously married, no other documents (aside from the birth certificate of the child to show relationship to her mother) would be needed and there is no need to secure consent from the child's father. Illegitimate minor children are automatically considered under the custody of the mother. No worries there.

The child will have to undergo a medical exam. Your fiancee can take her down to SLEC without an appointment. Has the child ever been ever been diagnosed with primary complex (TB in children)? If yes, your fiancee has to supply evidence that the child was previously diagnosed AND treated. Assuming the child has never had primary complex before, everything should be ok. The child will likely be administered a TB skin test and will test positive (most kids in the Philippines will test positive in a skin test), but the chest x-ray will come out negative...so you can expect the child's medical exam to take about 3 days instead of 2.

Will the child need any other documents besides the birth certificate and a passport like my fiancee had to get NSO,and stuff like that, I think not cuz she so young but just checking.

My fiancee was never married to the father so she got a CENOMAR to show the Embassy staff.

Its been almost a year since I last saw my fiancee in person and I sure hope we can be 2getr soon..it's been a long stressful journey so far!

But thanks to VJ forum and all the VJ members for there assistance and knowledge without it would have been much more difficult to get this far.

I'd bring the child to the interview, your fiancee may ask a friend or relative to come with them (the companion will need 2 photo IDs with signature to show to the security guard before allowing them to enter) to help her attend to the child while going through documentation. I doubt they will ask the child questions as she will be unable to answer on her own.

No NBI or police clearance needed, obviously no0pb.gifThe child will need 2x2 pictures and proof that her parents' marriage was terminated or her mom has custody of her (since they weren't married the CENOMAR will suffice..how many copies of the CENOMAR did your fiancee order? No idea if a photocopy will be ok to attach to the child's application...perhaps some of the other members can chime in).

The child will also need forms DS-156 and DS-157 (2 sets each). Don't forget the proof of visa payment on BDO or Citibank payment slip. Photocopy of the signed I-134 should also be in the packet, no supporting documents needed (since her mom will have the original with supporting documents). The medical results will be forwarded to the Embassy before their interview date.

Hi she can bring the child with her she will be under K2 visa. I advice you to better let your fiance bring the child with her less hassle, time and money. Im sure your fiance will miss him/her alot. Goodluck to your visa process.
