Should I do somthing now? would you help me here?

I got 221G denial at New Delhi Embassy on Oct.12th,2010 and asked for "Additional proof of relationship".I am searching here on VJ. And I did not find anyone who got approval K1 after asking additional proof of relationship(221G). This information is making my wait terrible.

Has anyone ever received a fiance visa at New Delhi after 221G, asking for "ADDITIONAL PROOF OF RELATIONSHIP"?

Unfortunately there are a lot of K1 denial happening after 221g and case are being sent back to the NVC.In all of that denial the main reason the embassy is giving is expiration of the petition and that they can not process the case any further because of no validity of petition and did not find that the relationship is genuine( Even after submitting tons of proofs).They are not even giving any opportunity for second interview or second 221G like other consulate/Embassies.

My petition has already expired on Nov.11th,2010,waiting for the decision of my case,I am very much worried of becoming a "victim". What should we do now,I mean should we take any help of congressman/woman? Will it be really helpful in keeping my case at the Embassy for further processes? We are not finding any way here. Please help us asap.

Please share your entire experience. Was that a American or Indian CO ? What proofs did u gave ? What was her attitude during ur conversation? What were the questions like ? Any abnormal questions ....each and every detail.

Also is it a yellow,blue or pink 221g ?

Once we know all this probably then we can explain better ? I have an attorney in US, I can put up ur situation to them and try to figure out some solution. Sorry again but DO NOT lose your hope and keep smiling.

Thank you Anurag for you help. Currently I am waiting for decision after depositing paperwork to the VFS on Oct.25th,2010.

agree with sachin here - you didnt say if you ever submitted the extra proof. Did you give them what they wanted? I think I replied before and said to give them all the evidence they're looking for, no matter how minute. I also mentioned that you can retroactively produce proof, ie, print an engagement invitation card. put an ad in the newspaper etc etc. Did you get a chance to do any of these things? Like I said, it would not be falsifying proof, since you guys did in fact get engaged.

as the red flags thing was pointed out before, you have 2 flags - an interracial relationship and the fact that you are younger than her. the latter may not matter much, but the inter-racial thing will raise the flags.

in any case, that point may now be moot, since your petition has since expired. I'm not sure writing to a politician at this point would help, b/c their offices will ask if you have a current petition on file (I know this b/c I did this - for both of my state senators and my local congressman). the moment you say its expired, I'm afraid they might say to re-apply and then contact them back.

You probably have been talking to a lawyer already, but if not, you should probably do so. they might be able to appeal the 221g, although i'm not sure of that.

finally, consider this as an option. it is FAR easier for a USC to get a tourist visa to India than vice versa, as you've already found out. IF AT ALL POSSIBLE, consider having your USC fiance come to India, get married and live with you. the plan here would be to get married, see if her parents/family can come to India (also far easier for them to do so than the other way around) and attend the wedding. After the wedding, either she comes back here and files a CR-1 green card for you, OR live w/ you in India and perhaps do a direct consular filing, or just the normal CR-1, if the DCF is not possible. If she has a job that lets her work remotely, then there's no reason why she cant move to India, get married and continue to work from India till you guys get the CR-1 interview and you get the visa. THEN you can move to the US with her. There is also the option of quitting her job here, and just moving to India as I mentioned above and then you would have to support her while you wait for the cr-1 paperwork. the main point here is that I'm trying to offer suggestions for the 2 of you to be together physically and not be separated. when together, you can come up w/ all kinds of solutions. frankly, what i've suggested is not that far fetched. after all, you're going through all of this to be together; why not take an easier road and just be together.

I wouldnt suggest anything that I wouldnt do myself and almost did what I suggest above after my wife and I got married. I was ready to move to Bangalore to be w/ her, but she's the one who said no. It was a hellish 6 months being apart, but we came through and were successful. But honestly, rather than going to lawyers and appealing, just bite the bullet and go to India and get married and then start with the CR-1. by focusing on planning a wedding, AND MOVING YOUR LIVES AHEAD (ultimately you DO want to get married; why let a K-1 stop you??? you can totally get married in India), will give you something to look forward to, rather than mulling on fixing something that may not be fixable...

anyway, just my 2 cents. wish you the best of luck!

I have submitted all required paperwork on Oct.25th,2010 and still waiting for the decision. WILL Senator/congressman help in getting visa OR they will just speed up/inquire the process?

She already contacted to the congresswoman and their office advised to wait until we get decision from the Embassy.

I have seen a lot of things come and go from that embassy.......we also received the dreaded 221g and gave them everything they asked for accept what they knew we could not provide and that being pictures of the engagement because of course there was no formal engagement we had decided to save our money for the wedding anyways they held on to it until it expired then sent it back as expired petition.......i guess you have to decide if you want to contact the state department and see if they will reaffirm it, file a new k-1 or get married and file that way as far as i can see that embassy feels they are finished with the petition......contact them via email and see if they have already returned it as expired if not then you might stand a chance if you can get your congressman or attorney to give another interview.

We have the same situation that we did not had any engagement ceremony and we did not provide any concern pictures(They asked for pic. before,during and after the ceremony including the name,addresses and phone no. of the guests not the immediate relative).Instead of that we submitted a letter explaining why we did not had it and name, addresses and phone no. of our family member/friends who were aware about our relationship.

we also submitted seven letters from her USC family members,letter from her employer,ring purchase receipt,chat and phone records,few pics.of us,letters from both of us and my parents. All were notarized.

Since then my case is pending with the embassy and embassy has not send it back yet.I do not know what was going on with my case,I mean I am not going to know anything until they decide to send it back OR approve us.

The response I get from embassy's email is that my case is still pending under mandatory admin.process.

Now I do not know anything that they are going to approve me or not, should my fiancee still contact Congresswoman requesting for second interview? what if they feel like approving visa without any interview.

Is there any other way I can know about the case status except getting the same damn answer of "Mandatory Admin Process"?

If she should contact congresswoman now, what request she should be putting in the letter,asking for case status or second interview or what?

we have the age gap of only five years but yes during the interview CO mentioned that "so you ALSO have age gap of five years".I do not think that is so significant FOR US but yes it could be significant for EMBASSY.

yeah thats pretty much what we did.....by the way we never received anything from dos that the petition had been returned just a phone text to perviz that they had returned it........

there is another vj member here that went thru so much trying to get their petition approved there.......what happened with them is she the dos reaffirmed her petition when it was returned to the usa by that time she had decided to move to inida and was about two weeks from moving she went ahead and moved there and went to the interview with him the second time around they had no problems and they are currently living in the usa and very happy.....so sometimes good things do come out of that office ....sure i would get a hold of your congresswoman now and make a big stink about it this is pretty normal behavior for that embassy........

I would do what Sara above recommends then and go the DoS route. Sorry unfortunately I just dont know enough about the admin process to recommend a proper course of action and I dont want to steer you in the wrong direction.
