RFE Received in Mail Today

I got the RFE today. This is what is says:

"This office is unable to complete the processing of your Application to Register Permanent Residence or Adjustment of Status, (Form- I-485) without additional information. Although USCIS received your vaccination record, other medical information was missing. Specifically, a review of the record indicates that you entered the United States pursuant to a valid K-1 nonimmigrant visa and all of USCIS records relating to you have been reviewed, but the U.S. Department of State medical forms DS-2053, DS-3024, and DS-3026 are not in any of those records.

Therefore a new medical form must be filled out by a civil surgeon and sent to USCIS. In order to process this case further, this requirememnt must be met."

Then it gives me the link to the Civil Surgeons, and gives me a deadline of November 27th, 2010 (Thanksgiving) to get it all back in.

This is such BS! How do they think he got the K1 Visa approved? It looks like they LOST the medical!

I guess so. At the bottom is says, "Please note, the vaccination record has been received by USCIS; therefore, the vaccination portion of Form I-693 does not have to be completed."

I called Dr. Seidon's office and asked for copies. Hopefully they can fax them to me.

I called USCIS and got through to a level 2 customer service rep. They suggested I called the border where we crossed, and gave me the number. He suggested that they could send me proof that they received and forwarded the medical, and that could be used in lieu of a repeated medical, although I doubt it.

I am also going to fax a request to the Consulate in Montreal.

I read that someone posted (sorry I can't remember who it was or what forum it was in) that they contacted their congressmans office and had the immigration liason look into it. Because it was an error on the part of USCIS they covered the cost of the new medical. I think there have also been a few instances where the information was actually in the file and the AO just overlooked it. Having the congressmans office have someone look into the file again made the medical magically re-appear. So this may be something you want to look into. Not sure how the election tomorrow will affect the efficiency of the congressmans office tho :(

We are hoping our congressman can help at this point. But being told by a USCIS officer that the California Service Center sends them out to basically everyone is very disheartening and a bit scary. I highly doubt that the POE officers keep records of such things. Is your case that the California Service Center as well? You might also get in touch with your local congressperson to see what they can do to help. The thought of coming all this way to run into this kind of BS is just beyond me.

We called the consulate in Amsterdam and were told that neither they, nor the doctor kept copies of the records once they were sealed up in the envelope. We are hoping our congressman can help at this point. But being told by a USCIS officer that the California Service Center sends them out to basically everyone is very disheartening and a bit scary. I highly doubt that the POE officers keep records of such things. Is your case that the California Service Center as well? Your local congressman would be the first place to go, at least it's where I went. I had to talk to his assistant, or secretary, or whomever she was, but she did say she was pretty sure they could help. I will be calling them tomorrow for a follow-up on it.

I think once this is all said and done, we are gonna look into having someone look into this #######. I mean, if the California Service Center IS pretty much sending this out to most everyone, it is WRONG on so many levels. This is a broken system and messes with so many people's lives.

I would also (and we are at the moment), send a response to the RFE immediately, as the USCIS Officer Fox told us to do. We are sending the USCIS a letter stating that the medical forms, which were NEEDED to obtain the K1 in the first place were handed over on Dec 12th, 2009 to the POE at the airport in a sealed envelope, and that the USCIS already has them. Not sure if that will do anything. But hopefully, between that and our congressman getting involved, something will work.

Our deadline is MUCH sooner, Nov 14th! We are freaking out, but really can't afford another medical. I mean, I guess if it becomes our last option we will have to do it somehow, but I should know more by tomorrow with our congressman.

I just called them today- had to leave a message. I made the appointment just in case Dr. Seidon says they don't have the forms. Someone else had the experience where they were told the doctor didn't save a copy of the forms.

When I contacted my Congressmans office I used e-mail and on the e-mail page they had a dropdown box where you could select immigration issues. I am sure each congressperson has a different set up tho. I would guess that they all have an immigration person working in their office (that is who I ended up working with for my biometrics issue). If you call I would contact the local office first and ask if they have an immigration specalist that you can speak to.

I just got a response from Montreal, who said that the forms that are being requested were contained in the medical. I then called the POE again, and this time they spent 15 minutes on the phone with me, consulted a superior, and told me that the brown envelope is forwarded to my local CIS office (Orlando). I looked up the Orlando office, and it says I can make an INFO PASS appointment, but none of the options relate to my case. I basically want to find out if they have my medical at the Orlando office.
