Hello everyone.

I got a double issue and was hoping to get some information so I can sleep eaiser. Thank you in advance for any information.

1. Age Difference: I am 25 & my fiancee (who is female/US citizen) is 33. Should I be worried about this? Anyone think I will encounter problems during K1 process?

2. We are not going to file for the K1 Visa for at least another 6 months, but my fiancee has been divorced for only three months at present. Will this be problematic?

I personally don't think that is a big age difference. As for the divorce, many people live separately for months/years before they actually divorce so I agree that that shouldn't be a problem easier. Good luck!

no,age difference becomes a problem when its out of norm in beneficiary's country.your age difference isnt that big.

also the divorce thing will be perfectly fine,just get a beep load of evidence ready,just in case they decide to get pissy with you

Age won't be an issue. I am 31 and my husband is 22. We went through the K1 Visa process. I was divorced 2 years when we filed, but that doesn't matter either, it just matters that you are both free to marry.

I've only seen age as issue if the woman is a lot older (like 25 years) and the man is from a high-fraud country.

I had been divorced for about a little over a week after we filed. No RFEs yet. As long as you are free to marry. USCIS won't care but the consulate may ask. Regardless, shouldn't be an issue.

Met: December 2009

Married: April 2015

Received CR-1 visa: February 2017

POE (as IR-1): April 2017

Oath ceremony: November 2020

I was worrying about the same thing. My husband's divorce was finalized last February and we got married last April. :unsure: But he's not living with his ex-wife for almost two years since he was assigned in Germany and then South Korea. When he got back to the US last June 2009 that's when he started filing for divorce. We met last July 2009. I'm a little relieved now that the USCIS won't make a big deal out of it but in case the consular officer will, i'll take ygr's advice and that is to bring loads of evidence. :yes:

1. If you were from a high fraud consulate perhaps but the UK is not a problem.

2. Possibly after you get married, not for the K1 though. Double-check the state requirements on divorce in the state you are living/filing in. There has been at least 2 people I'm aware of that re-married before a "state-mandated" wait period (after divorce some states make you wait 6 or 12 or more months before re-marrying) was up. This made the new marriage in their home state null and void, and they were not eligible to AOS based on it. One had to get annulled/divorced and re-marry after the waiting period. Ugh. all sorts of issues, so just check there are no "wait periods" in your home state that you might violate but given she's already been divorced 3 months and you're not filing for 6, you should be okay as the K1 will take 6 months making it at least 15 months by the time you marry.. I'd hope there's no wait period that long :S

Nah, shouldn't matter. We have a 9.5 year gap and nobody said anything about it.

If you are not even filing until it's been 9 months, I don't think it will be a problem. One of us had been divorced about 9 months when we filed (the ex had already remarried) and by the time of the interview it had been well over a year. Of course one of the interviewers at the Embassy mis-read the date and thought it had only been a few months, but the other interviewer told her to stick to the questions they were supposed to ask!

Some US states will ask you to bring the divorce decree when applying for the marriage license if it has not been very long since the divorce - where we will get married, it's a six-month threshold. But at the time of our wedding it will have been something like sixteen months, at least, since the divorce.

Make sure you have plenty of evidence to substantiate your "Bonafide Relationship". The concerns are valid enough to be prepared for questioning. The bottom line is that it is a legal relationship and both of you are free to marry.

Our age difference didn't seem to matter (17 years), but I think previous posters are spot on saying that it really depends on the country and situation. Time of divorce shouldn't matter either, so long as the divorce is final and you can prove that you are both free to marry. Good luck.

My advice is to not worry about it...the UK is not a high fraud consulate, so things like an 8 year age difference should not be an issue.

The divorce thing? They are only concerned that both are free to marry, not to pass judgment on the timing.

I dont see any problem

You should only keep on mind, that if your are concern then keep in maind that you need to prepare and shownevidences of bona fide of your doubts. For examole, showing good phone bill records, skype call log, visits. You know all the things that show in your possibilitys that you are in a relationship based on love. No matter ages differences or any other think.
