I-864 Affidavit of support and it's expiration date

Hello Friends,

I am in the process of preparing my I-864 affidavit of support to sponsor my spouse. When I downloaded the form from USCIS website (http://www.uscis.gov/files/form/i-864.pdf) I noticed that the expiration date is 10/31/2010 which is on the top right corner of the form as "OMB No. 1615-0075; Expires 10/31/10"

My question,

1. Does NVC rejects the form if it expires?

2. Shouldn't I use this form because it's going to expire soon?

3. Should I wait until USCIS upload new form to their website?

I am assuming that I have to send my AOS package to NVC next week.

1. Sometimes. Sometimes they will tell you in the "special instructions" on the website whether the previous form is still accepted, or whether it's not. usually there's some leeway during the "switch"

2. I would if you're filing shortly. After all, you still have 10 days till the form expires,

# Will it be a problem if I mail out the AOS package before expiration date ie. 10/31 and they receive/process it after 10/31???

I wouldn't think so honestly. If i were you I would complete the form as it is NOW and then when the time comes to submit it, just double check whether there's a new form. If there is, complete it (you'll already have exactly what you need in the one you've already done) and if there isn't, send the one you have

The office and business management (OMB) is the government agency that is responsible for official government forms. They have an established proceedure for submitting and updating those forms. It is the responsibility of each goverment agency to keep their forms current as the OMB assigns an expiration date to the official forms. The agency that uses that form may accept the expired form becuase they have not gotten around to submitting an update to the OMB.

The USCIS is slow in processing our visa applications and it would appear that they are slow in getting their official forms to the OMB. As long as you download the form from the official USCIS website, it SHOULD be the most current and the version they will accept. So I would use the form you have and not worry becuase the expiration date on the form is just another indication that the USCIS runs at their own pace.
