So excited can't function, need help!

Hey guys!!!

Submitted no objection statement for J-1 Visa Waiver and the result I JUST NOW GOT BACK is:

DEPARTMENT OF STATE DECISION: NOT SUBJECT

What does this mean? I'm so excited I can't function.... searching now. I thought it would say something like recommendation letter sent.

I can barely type and Noemy is going bonkers on my phone. :)

Does this mean we are not subject to the J-1 2 year HRR? I expected to receive a completely different status. Something such as Waiver Accepted.

I'm confused because all of her papers were marked that she was required to have the 2 year HRR.

Since we didn't have time to wait on a ruling if it was required and the papers were marked that it was I decided to go for j-1 visa waiver on no objection statement rather than check to see if she was subject. After I sent everything for the waiver I might have gone online for the advisory opinon and entered information to check for free if she was subject to the 2 year HRR. I just don't remember doing that. *IN FACT, I REMEMBER BEING AFRAID TO DO THAT BECAUSE I DIDN'T WANT TO MESS UP THE WAIVER PROCESS. So, I'm confused on the status.

What do you think happened here? I can't find a page anywhere with different status you can receive back.

That's not the letter. That's the status you can check online. The letter is days away from coming in the mail.

I've seen other status that say Accepted or denied. This surprised me and confused me! It seems more like an Advisory Status?? Anyone?

I just found this below. Does this mean that the consular officer made a mistake and we were not subject to the 2 year HRR???

For instance, adjudicator field manual available online says, for example, that if one submits waiver of two year requirement application to USCIS adjudicating officer has to verify himself first whether one is subject to it because mistakes of consular officers marking erroneously IAP-66/visa do happen and if determines that two year rule does not apply should reject the waiver application and inform the applicant that it is not necessary. So at least according to adjudicator field manual they acknowledge that mistakes do happen and they have means of figuring two year rule themselves.

I know it's hard and you are dying to figure things out in advance, but I would suggest you to wait for the official letter in the mail. At this point I am not sure what does your update mean, it is kind of confusing but keep your hopes high, I'm sure the letter will shed some light for your situation. :thumbs:

I know it's hard and you are dying to figure things out in advance, but I would suggest you to wait for the official letter in the mail. At this point I am not sure what does your update mean, it is kind of confusing but keep your hopes high, I'm sure the letter will shed some light for your situation. :thumbs:

UPDATE:

I don't know why the letter has not been received in the mail yet. When I sent the documents I not only included 2 stamped envelopes, but also two envelopes with pre-paid postage for over night delivery. That kind of makes me upset. HOWEVER.... :) :)

We called the US Department of State today to ask what the status DOES NOT APPLY means and the lady on the other line delivered a very happy congratulations and said you get to stay!!! :) :) :)

We are working through the getting married part. :)

She's talked with her family and I have to sit mine down. We are deciding if we are going to JOP or destination to some place like Vegas or Reno. I really love Lake Tahoe and would like to spend a long weekend there. It's just that I've heard Vegas chapel weddings are red flags. So, that kind of disappoints me. I'm not the big wedding with my family type of guy. I'm the I got married and cousin Sam finds out about it a year later type of guy. ;)

I have no idea??? I read this some where.... and I remember it being heavily emphasized.

I think it's because you can get rush license and married during the weekend. Where as in my state for instance, you have to go together get license, wait 72 hours, come back and marry in front of JOP with witness.

Personally I don't understand why it would be a red flag? I don't want a big wedding and I'd like to go somewhere other than the Dallas County Courthouse.

Hopefully someone can shed some light on this.

Personal opinion only:

I know people talk about "red-flags" but it's not as if one of these things will totally make or break your application. If you have many of these issues, then they start to add up. But it's not like arithmetic (+ red flag, -1 bona fide). They look at the TOTAL package. If you want to get married in vegas, then by all means do. if you want a court house marriage, then do that. That alone won't ruin anything, and I really don't believe that you can game the system and avoid red flags without looking suspicious, because they can tell you aren't being yourself. So my advice: BE YOURSELF.

What would be truly weird is if you didn't have any photos of your wedding. I see people on here who say "oh, we don't have any photos of our marriage" and I think.... uh huh.

Do what you want to do. A lot of AOSers have a courthouse wedding and then a big wedding party later. What USCIS needs to see is that you have a real relationship, and plenty of people who have real relationships get married in vegas.

Interesting!When we got married in VA, we got the marriage license AND we got married on the same day and nobody cared. It was our right to do so, and honestly we didn't even think about "flags". We never did!

In VA the marriage license is issued immediately, there is no "waiting period" to get married and you don't need any witnesses. The marriage license is valid for 2 months, that means you have 2 months to get married.

As you see, the process is similar with the one on Nevada. So what, really?If I were you, I wouldn't worry about it!

I dont have any wedding pictures. In my religion as I practice it photos of living things are not really allowed plus my wedding was simple. None of my friends have photos of their wedding either.
