EAD for K2 to obtain SSN?

Hi. Does someone knows if my son who entered on a K2 visa needed an EAD to get SSN? I got my SSN a week after we arrived and I was told in the SS office here in CA that I can apply for my son's EAD once I get my EAD. However, I have red in the forums here SS will issue SSN for K2 visa holders if they have EAD. My son is only 9 and we already filed our AOS waiting for approval. If EAD is neede for him, can I file for his EAD without paying the fees since I have filed his AOS already? Any advice will be greatly appreciated.

Timeline

I am also filing AOS for my k1 wife and k2 step child of 7 years old. The EAD fee is included in the childs processing fee for the i485.

AOS- Sent Nov. 8th 2010 Chicago Lockbox

AOS- Received Nov.12 2010 Chicago Lockbox

AOS- Received NOA1 Nov. 16 via email

AOS- Received Hard Copy Noa1's via US Postal Nov 18.

AOS- i485,EAD,AP for wife/ EAD for child touched Nov.19

AOS- Received Biometrics for mother and child Nov.22nd via US Postal scheduled for Dec 15th.

AOS- Went in for Biometrics. Dec 15th at 8am. Pretty fast..took bout 20 min in and out for mother and child.

AOS- Recieved NOA2 Jan 10th. Appt set for Feb.8th at 1:30pm

AOS- Approved Feb 8 Permanent residency

Yes, you can file for an EAD after you've already sent his AOS application. Send an I-765, along with a copy of the I-797C receipt notice for the I-485 you've already filed. There is no fee.

You might be better off just waiting until he gets his green card. My wife and her kids filed the I-765 at the same time as the I-485, and they ended up getting their EAD cards about 5 days before the AOS interview. If they had filed the I-765 after the I-485 then I imagine they would have gotten their green cards first. A green card can also be used to get a Social Security card.

Would be glad for any information anyone might have about this.

For the time being, I'm going to go ahead and submit the I-765 for her. If she's not eligible, they'll deny it.

For the time being, I'm going to go ahead and submit the I-765 for her. If she's not eligible, they'll deny it.

Have you filed your and your daughters AOS? If not then you can file EAD along with your AOS and it is free. She is actually eligible for an EAD, some file along with AOS since no one can really say how long AOS will be approved. I did'nt file for my son when we filed EAD since I thought we would get our GC in 2 to 3 months after filing AOS but unfortunately it took longer than that so now I am just waiting for AOS approval before I could get him an SSN. If you already filed your AOS you can apply for an EAD for her and send a copy of your AOS NOA so you don't have to pay the fee. EAD and travel document (I-751 and I-131) are free when filed along with an AOS application (I-485). And yes you are right they need SSN to be claimed as dependents on tax and sometimes depending on how strict your insurance coverage ... some do not cover someone who do not have SSN

K-2s can not receive a SSN until they produce an EAD or the GC.

I agree. I was told the same thing. I completed the same forms for my daughter as i did for myself for this reason.

There is nothing to be told, this is the truth. My wife (K-1) applied for her SSN within three weeks of her POE. We verified that the K-2 could not receive a SSN until he had his EAD or GC. We filed for the AOS, GC, AP and EAD. When he got his EAD, we went to the SS office and applied for his SSN no problem. Then when they both got their GCs we went again to the SS office to have them send out new SS cards without the No Work without DHS Authorization wording. Now they both have clean SS cards.

Yup, filed them yesterday with EAD applications for us both. I already had a SSN from when I was here in 96 on an L-2 visa, and updated the name on mine after we got married.

The only reason I need an SSN for her is to make tax filing quicker and simpler, from what I can make out. Otherwise, we need to apply for a tax ID number, or something...
