I need help from this forum members:

- A friend of mine's daughter came to the U.S. as permanent resident based on her marriage based sponsorship by her U.S. national husband.

- She was hardly able to live with him about nine months as she left her first love back home in Pakistan. Of course higher expectations, cultural difference, home sickness and distance.

- In order to get succeeded in her plan, with her parents support and feedback she ran away from home and took her own jewelery as well as her mother in law's jewelery also. Her husband was at work when she ran away from home.

- With the help of private NGO, she went to the local magistrate and got temporary restraining order against her husband. She also filed charges against her husband and mother in law for abuse and assaulting her.

- In first hearing of the case in the court, she was failed to get restraining order against her husband as she could not prove any danger or risk to her life. The case got dismissed.

- In second hearing of the case in the different court and different judge, after two and half hours hearing, she could not prove any of the charges of assault and abuse. There was State Prosecutor provided to her by the State vs her husband attorney. This case got dismissed also. Her husband has no criminal record etc and is peace loving young man.

- Now her green card is temporary for two years only. Its expiring in 09/2011.

- Her husband does not want her back in his life as he has no trust in her. She cheated on him and kept her affair even after her marriage.

- What are the options available for her if she wants to live in the States or she has to go back to her country etc etc?

Has either party filed for divorce?

She will have to file to remove conditions 90 days prior to the expiration date of her conditional green card or after the divorce if final whichever is first.

She WILL have to prove it was a real marriage which it sounds like she will not be able to do. Did the husband or mother in law file any criminal charges against her?

I will withhold my personal opinion of the person's motives and moral qualities.

- None of the parties has filed the divorce yet.

- This was an arranged marriage by the parents from both sides.

- She admitted her affair in writing with a handwritten apology for forgiving her affair by her husband but she kept it.

- She has gone to an unknown destination in NYC and attorney's fees are sky high and its not worth it to spend money.

- Her husband does not know her activities and social contacts.

- She made a statement in the court, she was looking for a green card, an apartment and living expenses from her husband to live independently on her own. The Judge rejected her demand.

Again, is there any way she can keep her permanent legal status in the U.S?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Just some clarification - reading over the other thread in this chain of events posted by the husband (this is by the husband's father) : http://www.visajourney.com/forums/topic/276248-immigration-fraud-victim-iam-us-citizen/page__st__15__gopid__4212057#entry4212057 it does not appear that the wife told a judge she came to the US just to get a green card. Her husband still has physical possession of her green card and she wanted to get her green card back into her own possession, plus have some sort of spousal support so she could live on her own. That is what she asked the judge for. The OP's phrasing makes things sound somewhat ambiguous but when you read both threads together you will see that there is more to this story than has been stated above. This was also an arranged marriage - it will be difficult to prove immigration fraud when the girl herself was not a party to the immigration process except as the recipient.
