After reading Bleauwolf's response maybe it is wise to send copies of entire I-130 filing along with EOR and supporting document's to NVC with DS-230 just to make sure Guangzhou receives everything. As I said before this is the second time for my wife and I. Want this time to be the last time with her getting her Visa and flying home with me.

I sure agree with you there. I was assuming my ALL of my I-130 would get forwarded from USCIS to NVC to GUZ. I will make more copies to send in with the Ds 230. Good time to update the EOR also....

After this post I think I know the specific issue which was likely her past visitor visa refusal in 2007 which I did not think would be an issue. I would be happy to share the detail of her circumstance for others to learn but I have already put myself out there so I want to go back in my personal shell (Teepee) and just fight for her like a warrior and I am sure we will be ok, just a little more time.

For whatever it's worth L was denied a B2 the year before we filed for the K1, and our CO acted like it was no big deal - and in fact, he seemed pleased that he had applied for it... but our circumstances at the time of the B2 denial were very different than yours (you hadn't met her then, so it wasn't relationship-related; we had been dating for a year and known each other for nearly two, and he had applied for the B2 specifically so he could meet my family and friends), as was our consulate (though, the fact he was denied in a year where over 95% of the B2s were approved was daunting before our interview).

Also, do make sure if you re-file, you properly kill this one first, otherwise you may get denial on the basis of non-bonafide for your I129F. And I strongly suggest that if you re-file, you:

a) Make at least one more visit to China before you re-file, and get plenty of photos of the two of you around China and with her family. It'd probably be a good idea if you made another trip after re-filing, so you have new evidence to include with Packet 3 (and show all of your passport stamps with the extras you send with Packet 3), but not really a requirement. It looks like you have two visits already planned, so re-filing between them would work.

b) Front-load the I129F, and given what Bleau said about the NVC, do make sure to include more at the Packet 3 stage (which goes directly to the consulate).

c) Most importantly, go to the next interview. I don't thing GUZ is yet at the point where both parties being at the interview is a back door requirement like it is in Colombia and Ecuador, but nothing screams bonafide as much as both people being there. If you have to pick between two trips now and one now/one at the interview, do the latter.

I think you should go to the next interview too. Let her bring your passport inside with her and keep a phone nearby so they can call you if needed. I read on another forum about a woman going for a K-1 interview in Vietnam (I think) and she took her boyfriends passport with her to the interview while he waited outside with a cell phone. From what the poster said bringing her boyfriends U.S. passport and him waiting outside in case needed seemed to help quite a bit and speed up the interview for her....she was approved.

Oh wow. If I were you I'd just get married and do the CR1 visa... sounds like your fiancé has been put through enough BS at the embassy. Plan a couple of more trips to visit each other and send more evidence...

Thanks for the advice after my bad attitude, I just was not prepared for a no answer, I guess I should have been less optimistic, but I also could not ignore her emotions that triggered me.

I knew the circumstance of her previous B1 Visitor and she had all supporting documents about that case with her and if the matter was a concern to the VO she was prepared to present artifacts about that case to the VO but he did not want to hear or take any of our standard evidence after he asked 3 questions and look aimlessly for 5 minutes before handing the white slip.

For whatever it is worth sent fax of a long letter I wrote to Guangzhou detailing her previous B1 case and how that should be a concern when I am her sponsor and all the evidence she tried to present for our case was not looked at. I did CC: my Congressman. I don’t expect anything action from this and expect my letter will be ignored.

Yes, planning to just marry in Chongqing 1st week of September. Sorry again to all.

My fiancee happened to be in Guangzhou that same week and made friends with Zheng, y2catalyst's fiancee. She helped Zheng with organizing the paperwork and making sure things were perfect. She had her interview a few days before Zheng, got approved in 5 minutes, 3 questions asked. VO just read my EOR, looked over some things, asked the questions, looked at pictures, spoke a little Chinese and gave the pink. VO was an older white female.

I was able to hear Zheng and Xue speaking a few times during our video chats and I'd sometimes catch Zheng speaking English on the phone. I can say Zheng's English was much better than Xue (this is the one thing i was worried about on our interview). According to what my fiancee told me, Zheng's VO didn't give her the time of day. I think they already had their mind made up before they met...

Really sucks. You can have everything in good order, and still get the shaft. I really feel his pain, I would be devasted myself.

Btw, I also visited only once, y2catalyst and my case were very similar. Will be going again first week in September to have unofficial wedding and bring my fiancee home. 1 visit and Xue's limited english were my true concerns about our interview, but she was approved quickly.
