K-3 vs IR1

-I am a US CITIZEN & have been married for about 3yrs and want to bring my wife to US. I have Filed for I -130 on May'17,2010.

-Received Notice of Action I797C, Online Status says "Review In Progress".

-Filed I-129F Spouse on June'18,2010 @ USCIS CALI center; Haven't heard anything back from them till date, I am worried after reading that in this site about IR1 that NVC will issue.

What do I need to do, should I apply another application for for IR1 with NVC or wait for the response?

I want to thank in advance for your valuable and Education suggestions.

if you filed an I-130, it will be for an IR-1 visa, on interview day, because of the '> 2 years' between marriage and first visa issuance.

The K-3 is mostly dead - see

So, you not need to file any new petition for an IR-1 visa, as your wife already qualifies to apply for the IR-1 visa - and you filed the I-130 petition already. Nothing more to do, really, until you get to NVC stage on the casefile. If you need info on NVC processing - please read:

FWIW, NVC doesn't 'issue' IR-1s, an Embassy/Consulate does. Sure - is some NVC processing that needs to get done, prior, even to have any interview date at an Embassy/Consulate, but NVC never issues IR-1s.

IMO, the IR-1 is a superior visa (10 year greencard after entry into USA), no silliness with Removal of Conditions process after the first 2 years. That , in itself, was major reason my wife and I have waited this long.

WOW, Thank you Darnell for your fast Response, Really Appreciate it. As per your advice, I shall wait for NVC to send me some information about my File. One thing i am missing in my I-129F package is a Cover Letter. I am hoping they wont reject my file for that reason.

IMO, you should hope USCIS rejects your I-129F in order to avoid delayed approval of the I-130. NVC will administratively close the I-129F anyway.
