Timeline

i got my passport today , and it had a mail said that : they send my case back to usa cuse they dont bealive our relation ship , and the passport had a visa stamped in it and over it there was a stamp say visa

canceled without prejudice

what that stamp mean , why they use it , cuse the counselor tell us we approved at the interview , what the sh>>>t is going on .

any help will be appercited

06-15-2008 : my fiancee first visit to me ( stayed 3 weeks ) .

06-23-2009 : my fiancee secound visit me in Egypt ( stayed 6 weeks ).

06-28-2009 : ENGAGED

10-29-2009 : I-129F Sent

01-27-2010 : my fiancee 3rd visit to Egypt ( stayed 6 weeks ) .

02-09-2010 : travel with my fiancee to turkey in a vacation (5 days)

05-25-2010 : my fiancee 4th visit to ( stayed 2 months ) .

06-03-2010 :Interview Date .

Interview Result : approved ( ya right ! )

07-01-2010 : we got a letter had my passport and over the visa stamp says ( canceled without prejudice )!!

06-29-2010 : case sent back to usa !!!

07-07-2010 : MARRIED

01-12-2011 : the letter state the k1 case is expired , and ther was no prob to file back for any kind of visa

04-25-2011 : my wife here now visiting me in egypt for 2 and half mounth yayyyyyyyyyyyy

05-18-2011 : travel with my wife to malaysia in a 1 week vaction

06-14-2011 : register our marraige papers in cairo

What visa was cancelled without prejudice?

I had my prior student and tourist visas cancelled in a similar fashion once my CR-1 was approved.

03/27/2009: Engaged in Ithaca, New York.
08/17/2009: Wedding in Calcutta, India.
09/29/2009: I-130 NOA1
01/25/2010: I-130 NOA2
03/23/2010: Case completed.
05/12/2010: CR-1 interview at Mumbai, India.
05/20/2010: US Entry, Chicago.
03/01/2012: ROC NOA1.
03/26/2012: Biometrics completed.
12/07/2012: 10 year card production ordered.

09/25/2013: N-400 NOA1

10/16/2013: Biometrics completed

12/03/2013: Interview

12/20/2013: Oath ceremony

Timeline

"Without prejudice" refers to closing a case without preventing it being brought again.

I don't know why they used it or what would cause it to be used, after being approved at the consulate.

Hmm, sounds like they approved your visa verbally at the interview. It was then attached to your passport and now they've denied your case because they believe your relationship is solely for immigration purposes. Since they can't damage your passport by tearing out a page, they cancelled the newly attached K-1 visa. Most visas are cancelled in that manner - 'cancelled without prejudice.'

I'd definitely contact the Embassy and see what happened and what changed after the interview.

So, you had the K-1 interview.. All the process was done and got approved by the Officer at the Embassy.. Now you got your passport with the cancelled stamp.. Obviously no reasons given..

Why someone posted you call the embassy so many times? If that was a possible issue, perhaps calling again is not such a good thing, perhaps an attorney may be able to help now? your congress man?

It means there was a visa issued and then something happened indicating that the visa was issued in error or prematurely. This happened to my fiance. His visa was issued and after it was issued the consulate realized they forgot to have him sign one of the required forms (I think the DS157 .... whichever form requires the signature in front of the CO).

I'm sorry that happened to you A. It does seem kind of strange. I would definitely be calling the embassy if they didn't include some kind of paperwork explaining why the visa was cancelled. Perhaps it is just a form that wasn't signed, but no way of telling unless they put it in with your passport.

If the embassy was worried about people calling multiple times, they would be cancelling out a heck of alot visas! I am sure that is NOT a reason to cancel out the visa.

They did explain why they cancelled the visa. The consulate did not believe the validity of the relationship.

I'm wondering, since the stamp is in the passport already and stamped "cancelled" how would this affect any future attempts at securing a foreign visa? Would this be treated differently than a case that was simply denied at the interview?

I'm very surprised at the latest denials out of Cairo. It seems like Casa and Cairo are denying K1s like crazy.

My husband had a stamp in his passport that stated he had applied for a visa and it was rejected - he wanted to come visit a friend in the US, but Argentina was going through their financial crisis and the USEM wouldn't approve anything for a young, single male. The CO asked him about that stamp and he had to explain what happened. In A's case, if it states that the visa was issued and then canceled - ummmmmmmmm, that is definitely a very bad sign, especially if it shows the reason.

I would forget K1 all together if I were you. You may want to try for a CR1. I don't know how that stamp in your passport is going to affect any other visa attempts but you could try for a CR1. You'd have to get married in Egypt before filing for that one.

I asked my husband about that (losing the passport and getting a new one), he said it probably wouldn't help any. The information is already in the system and the passport office may indicate something on the new passport. When I told him about this particular case he was like :blink: holy ####### :blink: . He's surprised about the denials but feels it was a long time coming considering the fraud situation in Egypt.
