First, congrats on the visa :D

My concern is for later in his life because he is listed as your biological child as your name is on his birth certificate.

I think you should speak to a US lawyer and ask whether or not they think you should have the certificate amended and whether not changing it will cause issues for your son in the future. Technically because you're listed as his father he is a USC, but he can't get USC unless you claim it for him.

I don't know. I just think you should ask a US lawyer and see what they say about it... just to cover all your bases.

p.s. Good on you for being such a good person about it. I think we need more honourable people out there like you.

ok so the i864w is meant for certain cases such as intending immigrate is a child who will become a u/s citizen immediately upon entry under the child citizen act 2000. yes it seems you need to call someone and talk to them as this form is for US citzens child,adpoted child, but i dont see stepchild. I never filed this form.

I wish you luck and I am sorry your wife had to go through That.

4. Could you please explain why your Name is on his birthcert?

Yes sir

Because he was born after we were married

5.Could you explain his relation ship to you

Well sir, I believe he would be considered my stepchild because i am not his biological father

5 Would you put that in writing for us so there is no misunderstanding?

After Writing this document explaining the situation He reviewed and Said Well... everything looking like its in order..Your Visa's are Approved !!!!!

3/31/11- Interview date! Approved!!!!!!

First I want to congratulate you on the approved Visas.

Then I want to once again express my admiration for you as you have handled a difficult situation with a lot of class and helped your wife retain her dignity through all of it.

Definitely talk to a US Family Lawyer about the requirement for adoption once he's here.

This whole thing started after we filed for K3 visa and it got switched to CR1/CR2 visa in February and I had to submit a petition for my Stepchild.

The Petition was approved and sent to the NVC this is where the confusion started

where a signature was required i even signed as Stepfather of....

I have stated in all my documents and letters to the NVC that he is my stepchild and not my biological child.

I guess i will wait to see what the NVC supervisor has to say about this case

Everyone please keep in mind

my stepchild is here today because my Wife was Horrifically raped while she was staying at a friends during our engagement period We had originally planned to be married in Dec 2008 like we did. I had asked her the previous year for her hand to married.

I hope there is an answer somewhere...

First of all sorry to hear this happened to your wife.

I854W you they sent you, fill out.. attach explanation maybe..?? Never heard of this..

hello to all First i want to thank everyone for there support and comments,

Ronny Jr will com to USA on a CR2 Visa and the I864W was not required just the I864

If anyone every goes through this kind of Journey just be patient and honest. Support your spouse and be prepared to have a written response.

If the petitioner can be there at the interview it was i think the deciding factor in the approval. Because of they asked me to write a written statement explaining the time line and relationship of our son's birth

Again thanks to everyone...

I will be proceed with an adoption once were in the stated and this will give our son a chance to become american citizen later on thru the Childrens Citizenship act of 2000

I would like to thank you Ron and Elvira for your posts concerning your situation. This has helped me greatly as I am in a similar situation. My petition for my wife and son (stepson) was finally approved by NVC and sent to the US Embassy in Manila for their interview on December 6, 2012.

I plan to be there and I am crossing all my fingers including my toes that everything go smoothly on December 6. I will post our experience concerning this, and we sure hope that we get the same CO like you did.
