Filing for I-130 for son

My mom is getting ready to file I-130 for her son(my brother).

Here are the documents we will be submitting in the next day or so.

Petitioner: My Mom

Beneficiary: Her son(my Brother)

  • Cover letter letting USCIS know that mother(LPR) is applying for her son(unmarried and over 21)
  • Check made out to U.S. Department of Homeland Security for $355
  • Form I-130 : Petition for Alien Relative
  • Photo of front and back of Permanent Green Card(Petitioner)
  • Birth certificate of beneficiary showing his date of birth and petitioner's name(but the certificate does not have beneficiary's name)
  • Sworn affidavit from petitioner stating that the birth certificate attached is her son's(the beneficiary)

Anything else needs to be submitted? Please let me know...

Hello. it depends.

My brother is currently in the US on a student visa so for #14, she provided his status along with I-94 details that's attached to his passport.

So you need to mention what status your son is and his I-94 details.

i need help with this...

my mom (US GREEN CARD HOLDER) applied form i-130 for me( SON UNDER 21)

on 4, 2002 while i had F-1 Visa in California center.

priorety is date 2002.12.29.

and i got my approvel notice on 2005 .

so what is next for me to do?

it has been 2 years my mom is usa citezen.

which form should i use to change the benefecionry status from green card to usa citizen

help appreciated

filled out i:130 unmarried son over 21 in 2003

I30 approved in 2005

NVC 2009 requested for affidavit of support

NVC 2,3 2009 affidvated support accepted

NVC 5.2 2009 requested to fill out DS 230-1

Am not sure but I believe you just need to send in a cover letter asking USCIS to upgrade the application and include a copy of your NOA(from I-130) and also a copy of your mom's passport).

Just posting an update since the priority dates have moved so quickly in the past 3-4 months..

Jumped from 15Nov02 to 01Jun05 for F2B category for India..Other countries have also seen significant changes(except Mexico)..Hopefully they will continue to move quicker...

Received 'Request for Evidence' in the mail.

USCIS wants the following:

  • Birth Document - Issues by a civil authority(we had submitted one from the hospital) or non-availability of birth certificate along with secondary evidence.
  • Name Difference - Birth document from the hospital does not show the full name of the child nor of the mother ( its typical to show only the first name of the mother and/or child)

What's scary about the RFE is this wording - "Pursuant to 8 C.F.R. 103.2(b)(11) failure to submit ALL evidence requested AT ONE TIME will result in denial of application.

We will try to get a birth document from a civil authority and also for name difference, submit an affidavit.

We submitted the following documents in response to RFE about 3 weeks ago.

  • Birth Document - Issues by a civil authority along with a notarized affidavit from Petitioner stating that the Beneficiary is her child.
  • Name Difference - Submitted copies of passport along with a notarized affidavit regarding the name differences.

Received an email today that the application was approved..yay! :yes:

Now, the long wait begins for the priority date to become current!!! :whistle:

Received a letter from NVC advising that there is no VISA number available(which we knew) and have to wait until next communication from NVC.

Priority Date is June 2010 so we have a long way to go.
