hi guys,my name is grace i am new here..i have alot of things in mind now and headaches..i am divorcing my husband now and trying to renew my greencard..i only have the two year conditional greencard and it will expire this coming july 21,2010..becoz i divorced my husband i have to file for the 1-171 alone..and the bad thing is we dont have enough evidences that i can show to the immigration,.the only thing we have is the joint account..i divorced my husband becoz he is not taking care of me,i love him so much but he doesnt care of taking care of me,providing my needs...we dont have mortgage evidence becoz we only lived in his friend,we never had a car together becoz he cant afford to buy a car,infact i am the one who gave him a car coz my girlfriend gave me a car so i gave it to him,he doesnt claim me on his taxes becoz he said i dont have a job and he owe alot from the IRS,.when were married he alwes threat me for a divorced and that scares me sometimes he will pack all his stuff and lived and i was hospitalized becoz of a depression and the doctor gave me anti depressant,so i lived and move to other state..i tried talking to a lawyer to help me but it cost $3,000 and without assurance that i cant be deported..i dont have dat money to pay for him so i wanna process it alone...can u please advice me what is the best thing to do guys..i really need help so bad..thank u so much.....ivy

You got to do it on your own, and file for a waiver. You will have to show that it was a legitimate marriage, up to the point of your divorce. It has been done successfully here on Visa Journey, and some of those folks can give you the benefit of their experiences. Good luck, and it can be done.

I did my waiver on my own without a lawyer. However, depending on your situation, you may need one. Most importantly you'll need more evidence than just a joint account. Do you have letters addressed to you at your address? Address on your drivers' licences? common bills?

When did you get married? when does your conditional GC expires? When did you file for a divorce?

GRACE:i got married february 2008,my conditional GC expires this coming july 21,2010,i filed a divorce two months ago..i dont have a drivers license,we dont have bills coz we live in his friends haus,yes i have some mails that is address on the haus we live..i am in san francisco right now and he`s in texas..i moved here a year ago..i dont know what is dat waiver..thanks for the reply...

Waiver = I-751 that isn't filed jointly.

Correct me if I'm wrong, but this is what I understand about your timeline:

Married: February 2008

Greencard Issued: July 2009

Separated: May 2009

Filed for divorce: March 2010

GC expires: July 2011

And with a joint account as the only proof? No bills, no driver's license, no insurance, no lease, no taxes, nothing?

Did you have any letters directed to you and your husband to the same address? even separately?

I think you may have a very difficult time trying to convince USCIS that your marriage was real..unless you come up with more evidence.

-this are the correct dates...i saved some letters and mails that is addressed to me and my husband...we dont have any payments together,no bills no properties coz he never had nothing even a car,cant even afford to rent an appartment..
