Mandatory AP in New Delhi Consulate in India

Hi Friends,

My wife had CR-1 visa interview at US embassy, New Delhi, India on May 6th. I was there with her but American lady CO didn’t ask any question to me. She was ok till she was asking question related to our relationship but when she saw that my wife had applied for F-1 visa in 2007 (same year we started chatting), CO started asking questions related to previous applied F-1 visa. Questions like when F-1 was applied, how many times, what was the outcome, what is my wife’s degree and what was the specialization area in her master degree?? Then she told us to wait, you’ll be called again. After half an hour we were called to different window by an Indian guy, he told us to submit my wife’s resume and was given a letter saying our case undergoes mandatory AP. When we asked what the reason he said that system will require longer processing time, it may take 2 to 20 days processing and at the same time he told us your visa has been granted so nothing to worry about. But we are going crazy what they are going to check and why we are put in AP.

Here the background of our relationship-: We met through a matrimonial website and started chatting in late 2007 and my divorce was not finalized that time. My divorce was finalized in March 2009 and we got married in oct 2009. My wife had applied for F-1 visa in the same year 2007 when we met.

I don’t know what they are going to check and what was the reason we are put in AP??

my wife is also under ap from last 6 weeks. there is nothing u can do. just wait. u can call dos office at 202 663 1225 and keep checking the status although they don't tell much other than that your case is under ap. just a waiting game and praying will help. good luck. i hope ap ends for everyone soon.

not to disappoint you but i am also going through this and people in New Delhi consulate are horrible

so here are the things they did with my case in new Delhi

1 put on AP

2 after three months called and accused the beneficiary of lying and all kind of other unreasonable things

3 varified most of the documents with issuing authorities

Hi Singh, and RB,

did they kept the beneficiry's passport or returned it?

What time line they told you guys. They told us 2-20 days and also said that visa has been granted.

By reading the stories here I do not beleave them what they are saying. Strange thing was that I was there She did not talk to me.

sorry to hear about ur situation. u r right delhi consulate is horrible. did they put her on ap at the interview or did they ask for more documents. how u know they verified documents and if u don't mind asking what did they accuse ur wife off? what did they tell her when they called her.

I'm in AP, but I wasn't accused of anything. My documents are complete, they accept our relationship is valid, it is just taking longer than normal to complete processing.

Hello,

It has been 12 days,still no words from Embassy or VFS. Very frustrating, they should not play with peoples life.

Hi Guys, so now I am in the same boat.

My wife is a US citizen and we got married in December 2010. We filed I-130 in March 2011 and had our interview on 4th May 2011 at New Delhi embassy. All seemed to be going well till we got to the CO for the interview only that he hardly talked. We had got the interview intimation only on 2nd May so I didn't have my medical report with me. Just after asking where I work he handed us two sheets. One was the g221 asking to submit the medical report along with my passport at New Delhi VFS and the second sheet was the dreaded mandatory AP letter. My wife was so angry as the CO didn't ask her anything neither did he see any of the photographs (we had submitted about 20 photos with I-130 and they were there in his file but we took about 100 more photographs with us). So all in all the interaction was very brief. I don't know what to make out of it. I am going to submit medical report and passport on Monday. Do you think VFS guys would have any information on this?

In hindsight I feel it was my wife's tax returns which might have created issues. My wife has been working in India for the past five years and as per US internal revenue services rules if you spend more than 330 days in a year outside of US and your income is coming from non-US sources, then your income is tax exempt up to $91,500 (my wife never made that much). Accordingly my wife's tax returns on I-864 were in negative since she is also repaying her student loans and the interest on study loans are also tax exempt. She had all these documents ready with her to respond to any such queries but the CO just didn't talk at all. Do you think it would be helpful if we also sent these clarification when I submit my medical report and passport?

Personally I don't have a positive feeling about it and looks like I have been sucked into the vortex called AP.
