Hi everyone,

My wife and I went to the embassy today during a walk in clinic. We were lucky enough to have a nice consul lady who at least listened to us. She said that my name came back as a "hit" on ICE that I was deported for drugs. She said that if it was a small amount of drugs we could file a waiver. We said yes but this isn't true I was never arrested or charged or deported or even told that I was being deported for drugs. She said well if you want to expunge your record you will have to hire an attorney. So either route for us is going to be a long one. I can't believe it. She also said that it could have been a clerical error that they hit the wrong thing on the drop down menu and that she would look into it as much as she could and try to find out.

So here we are, still don 't know what to do. Can't believe it.

Yes you do need a lawyer, and I dont think you guys should have told her "yes" if you knew it wasnt you. That said you need to get this sorted out asap. From your timeline, I see that you both have been through a long journey, so I wish you all the best in clarifying this issue.

I am soooo sorry... I hope that they find the clerical error soon. It is very frustrating when you have to pay for someone elses mistake.

Im sorry if you explained this in another thread but let me get this straight as I understand it...

You were here in the US and you left on your own(not asked to leave,deported or otherwise) and you went back to JO? Were you EVER arrested for anything here? Are you saying that you never had ANY run in with the law here yet they are saying you were arrested and deported?

sorry to ask so much but it seems odd that they have your name/dob and info on record for being arrested and deported if nothing like that ever happened.

Im trying to think of ways you could prove it without having to hire a laywer. I still say as someone else said in your other thread; your wife should get her local congressman or senator involved if the above assumptions are true. I seems like it could be a relatively easy fix if you have never been arrested or deported here yet they show you were. You could find out the dates that said event took place and show proof you werent at that location ect ect ... maybe i am just too optimistic or naive but it seems like with some help from a rep and some leg work by your wife here you could get this straightened out.

I just dont think you need a lawyer when in fact there shouldnt be a record to expounge in the first place.

Once you walk a mile in their shoes you will understand and be heard.

Hi Lisa,

Yes, I was deported in 1997 for overstaying a visitor visa. I was never, ever ever arrested and charged with ANY crime while I was in US. Also, when I was deported for overstaying the visa, no one ever said anything about having a drug charge or being barred to enter for life or anything like that. I was given a paper that said I could re enter in 10 years but I was so upset at that time, I ripped it up. Sure wish I had that paper now. That's why I was so shocked with this outcome. I have never even seen an illegal drug so this accusation is so outrageous and dirties my name.

Thank you so much for the link. My wife will contact the senator office on Monday and we will start to file the FOIA form with USCIS. I hope we can get what we need without trying to find a lawyer.

The paper they give you when you are deported don't usually give all the information anyway. My husband's paper said he was banned for 10 years for overstaying his visa, but there was no mention of the lifetime ban for fraudulent entry.

I really hope you can get this straightened out.

Thanks for explaining. I hope the FOIA gives you guys a good start and the rep can help your wife get everything straightened out here. Just a thought....If you had been deported for a drug offense, there would be a police record of an arrest... she can focus on that(that there isnt one). Thats where I would start.

any word back from the nice consul lady ?

They can initiate a new search on you, if they WANT to, back at the consulate.

Some one would have to be convinced to 'do it again' because of clerical error, though.

Namechecks suck, when done wrong.
