Confused about K3 and CR-1 + G325A

I will say sorry now as im sure you hear this all the time but im so confused on all this visa stuff..i will explain my situtation first and then i have a few questions.

Im half british half german living in Germany due to my dad being in the british army. My husband who is in the US army was here in Germany and moved back to the states in Jan this year. We got married on 10.10.09 in Florida and i came back to Germany. We didnt have the K1 visa. While i was in the states we spoke to JAG and we got told to file the G-325A each and he has to do the I-130. Then i coould go to the states and we apply for the K3..Simple as :wacko: So she says!!!

I have read alot that the K3 is a waste of time and that we should apply for the CR-1..No one can seem to tell me what is best in our situation. Is there a cost and time difference?

Is there anyway i can live with my husband until we have the visa?

This is all so confusing and it sure doesnt help that im a lil blonde too :innocent:

Question to the G-325A:

1.I worked as an aupair in 2008 but it was done privatly do i put that in for employment or do i just leave it. I would write that i worked as an aupair but i cant put and address as i left on bad terms and also it was a military family and dont think they live there no more.

2. I have both british and german passport and it asked for nationality? do i just put british/german?

What is the actual process with the G-325A and the I-130? How long does it take?

Timeline

There is no 'official' time difference between the K-3 and the Cr-1. However, if you do some reading, or have been around here for a while, you'll know the K-3 typically takes longer than the Cr-1 because once you get your NOA-1 for the I-130 and send in the I-129F for the K-3, your petition gets pulled out of line and both petitions put together, placed at the end of the line, and are adjudicated togehter. When we applied, K-3's were being approved 6-8 weeks after the Cr-1s.

Stick with the I-130 for the CR-1 - best bet in my opinion

For the G-325a you should NEVER lie on any of these forms (as it says on the bottom of the form). If you worked as an au pair in the US then list it - even if you left on bad terms. USCIS is likely too busy with all the other stuff they have to do and won't check up on anything.

I'd list and submit both passports since you have dual nationality.

Typically it will take between 6 - 10 months from start to finish. You can visit on the visa waiver program during processing but you cannot 'live' with your husband during the processing - only visit and the duration is up to the border patrol at the time of entry. Make sure you have ties to your home country to show intent on returning and not 'living' in the US.
