Timeline

My language is not very well... but I have an important question

I'm a Pole, my husband has double nationality ( Polish and also American). We got married in Poland, and now he is in the USA. We want to live together.

We started to paper works in August-in the USA, yesterday we got a NOA1 after 2 months. How long it will be to get NOA2?

Waiting so long for a NOA1 is a reason to worry? Could it mean that we will be waiting for a very long time? Embassy in California is looking after it.

I have only 19 yeras and this situation made me a lot of stress...

You got an NOA1 after two months? Wow. Shouldn't have taken more than 2 weeks. What is the stated date on the NOA1?

NOA2 for California Service Center is currently taking 5 months officially. Unofficially, about two - six months.

Don't stress right now, there's a long way to go. You have a great resource here at VJ and knowledgeable people willing to help you.

Hi,

Depending on where you live you were supposed to send the I-130 petition to the right lockbox. Perhaps, you may have sent it to the other location and this could be why it took long for an NOA1.

Some people have received there NOA2 in a short amount of time (3 months). However, some get it at 6 months. So, just have patience, and hang in there, CSC is pretty quick about pushing the petition thru, however the mandatory background check is primarily what determines it. so, if you're background check goes smooth, you should be slying though...

98% of petitions get cleared of background check almost immediately, the other 2% are resolved within 30 days, out of the 2% that don't get resolved within 30 days, they have 90 days to resolve them.

My husband didn't sent it on his own. He asked for help an office in Chicago- some years ago they helped him in also very important thing. They helped in all this paper work. They have a lot of works conected with imigration, and I think that they know what they do...

sachinky: I will send you stated date on the NOA1 later, because I'm in Poland and everything is with my husband in Chicago ;) I supose that he is sleeping now ;) ( differences in time- 6hours)

That's bizarre. Our NOA1 took a month. But that's because they had mistakenly cancelled our petition. Maybe your NOA2 will come sooner.

I smell RAT there. I would question the attorney or whoever did the paperwork. Ask for a confirmation number that papers really sent in August 26. What day it is delivered to USCIS? What address they sent it? Your husband already lives in chicago, so they probably received it same day or next.. Just Question this .. Then you can have most questions answered. Just heads up.

There's a mistake or negligence from the side of sender. Who sent the documents to the USCIS?

Did you hire an attorney? If Yes, no wonder. :angry:

May, 25,2010-Wife told me that she is pregnant ^_^

Inezand,

I'd tell you to monitor this case yourself (or your husband too) on the USCIS website. No one really has "connections" with immigration, many polish lawyers or associations say that to get you in. Its your case, so be sure to monitor it. On the website you can enter your case and see the status, watch to see if any RFE is sent, or the NOA2 approval issued.

Like a previous poster noted, something smells fishy. I'd say the attorney/association didn't mail your packet when they said they did, 2 months is very long. USCIS says to call them if you dont get NOA after 30days, much less 2 months.

Don't rely on what attorneys tell you, some lie to give you delays, to pay them more money, etc. Its your case, you need to take charge. All of VJ is here to help with questions along the way.

Sorry - the 'office' is lying to your husband. He might have thought he 'finished' the paperwork on that date, but it didn't leave the 'office' on that date.

Is he interested to join VJ, study the I-130 guides ?

This is again me...

When NOA2 will come, my husband has to send to the embassy something, or just wait for another message? He is going to Poland, and it is possibile that during stay there, NOA2 will come... what time is between NOA2 and next mail?
