Picked up by ICE at home (K1/AOS applicant)

This is a story from a man who has PMed me occasionally since last year, and wants to remain anonymous. I don't know the exact timeline, but he is Pakistani and got a K1 visa in late January. I'm not sure when he entered the US, but he got a SSN immediately and also married within 90 days. He was working on AOS papers in mid April, but it was May when he finally got all the documents and I-693 immunizations together to file. He filed and has an AOS receipt.

He would like to inform people what happened to him and also wonders if there is anybody who could comment or speculate about why this happened. I personally haven't heard of this happening.

I am gonna also want if you could educate more ppl here on VJ about this thing but please don't mention my name. It is about filling out AOS after 90 days..Alot of ppl here thinks (which is true) that there is no timeline for AOS filling but you should apply asap. PPl also get approved no matter how late they apply for AOS after marriage within 90 days. Anyways the story is I applied for AOS on may 22nd and got a receipt within a week. But on may 29th I was caught by immigration guys at home and they took me here at immigration center. They told me the reason why they took me here that I am out of status and i didn't inform USCIS about my marriage and other stuffs...When they came home i showed them my marriage certificate and everything, I was even with my wife and sleeping when they come. I didn't have any idea what was realy going on. My wife was worried and literrily crying.

But the immi team became polite when they saw my paperwork and everything. I also informed them that I have applied for AOS so what's the point to come here and take me to immi dept..they were like they have not record and have ordered to bring you at immi dept. I then said. I didn't committ any crime and also have no problem to resist so I can go with you! they held me there around 4 hours and released me saying that I HAVE TO report on the set date and time to this dept once again and then this dept will give you court date where you have to produce your document and recipt from USCIS that I have actually applied. The cheif of this team was also involved and he told me with a smile that You shouldn't be worry about anything. Just show your paperwork and receipt before the judge and this hearing thing will actually help me out to process my case faster, because when the judge sees these stuff he will order to issue your paperwork right away so your AOS process could be done within 2 months rather than 6 to 8 months...

But nichole I am wondering why this thing happened to me. There are Thousands of ppl who are married within 90 days but apply for AOS after sometimes. The same thing i told to the cheif that I didn't do any crime but yet i can understand that i should apply asap and let USCIS know about my current status wheter or not I am married or what?..I dont know if someone complained about me or they were realy tracking me if I have applied or what.

Let me add you onething. There was this lady immi officer, she told me that USCIS have sent you two notices but you didn't respond to them thats why we are here to get you. I was like TWO NOTICES? I DIDN'T GET ANY OF THEM.

I am not sure what realy happened but does it make any negative impact on my AOS case...

I hope you would give your opinion in this regards...

Kindly do not use my name while u tell other ppl to apply for AOS to avoid immi raid to your house as you can be out of status and USCIS doesn't like that at all i guess.

I dont want other ppl to get harrassed as I did by immi dept..

I have seen cases like this, but mostly because the people didn't have the NOA.

In this situation, it may be because of the delay in the AOS, and the two notices not being responded to. (which is to say, what were they?)

But the "cheif of the team" is correct, once he shows the paperwork that he filed, things would sort out, just a hassle.

It won't affect the AOS, unless he didn't respond to the notices, did he?

But a good warning, not to wait for the AOS, to get it done asap.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

He is not aware of any notices being sent. He never received notices, but he did get his AOS receipt. He is living at the address that he put on all his K1 and I-94 and AOS paperwork. The notices bit doesn't sound right. What kind of notices would be sent if you've done every step of the way by the book and there's not been enough time for an RFE I wouldn't think. It's strange. I think somebody turned him in maliciously.

Looks like your friend didn't file in time in time after the marriage and the 90 days expired.

At this point fear is not an option,

4) never trust ICE

I wouldn't dare to guess what they were - would be of an interest to know that, can you ask him for more details?

Turning him in, if they knew he was pass the I-94? perhaps - but they would need to "know" that info. Perhaps his wifes family?

I asked questions about illegal work, GC scamming, or anybody that would have turned him in ...neighbors who didn't like Muslims, former husband or boyfriend. Here's more story......

no I am not involved in any work so far. the landlord who lives upstair he is from the same country where i belong to. He was basically been trying to get involved with my wife when i wasn't her fiance. He been also tryin' if she could marry him thou! but when she mentioned that she has boyfriend he stepped back. But on couple of occasions she told me that he has tried to misguided her about me as i might be marrying her for green card and i would leave her after that...even on the day when ICE took me to immi center he goes with my wife at home that YOU DONT KNOW HIS BACKGROUND and may be ICE found out something against him....Our house is open to him all the time when we are away...he can look on things what we have in the house..when i got my marriage certificate in mail, it was opened already, when i asked him how it can be opened he goes Oh i am sorry i thought that was on my name thats why i had to check wheter its my mail or not...(let me mention, the mails we get, comes from this guy cuz he has the key of mail box.) on that mail there was a name Mr and Mrs Mxxxxxx, which he said thought may be on his name. (again let me mention, he always gets his mail with Mxxxxxxx and his name), but i dont know what were his intentions to open my marriage certificate. I am not sure if USCIS sent me any notices or letters or he just hide them on purpose.

Anyways as i told you earlier, I know my wife for about 10 years, so i dont think if any of her friend has turned me down on this ground if i am takin' advantage of her for green card. I love her and I have also no problem if we ever need to live in Pakistan, on top of that i don't have green card lust, all i wish if we could die together when we get old ....

i dont know what to tel you but this ICE thing realy scared the ###### out of me.

Will swoop in to "comfort" the poor woman....

Plus - as the landlord, he might of "liberated" some mail, perhaps, some notices from USCIS?

What do you mean by "in time"? Is there a deadline to file?

In this case, I wouldn't waste my money on an attorney because one is not needed. All he has to do is show his receipt which is dated prior to the "raid" and the case against him will be dropped.

ICE does not follow the status of individual cases to show up at a person's door like that because they haven't filed right away. I've met people who have been here 20-30 years (illegally) and have never had any issues with ICE. I don't buy that they went looking for a guy who didn't file within 90 days. :unsure:

Here are a couple possible scenarios that I thought of, as crazy as they may seem:

-he's Pakistani, maybe some paranoid/racist neighbor doesn't like him living in their neighborhood and reported him to ICE as illegal alien, the word terrorist may have been used as a "trigger" to get them moving

-a crazy ex-boyfriend from his wife's past reported him

EDIT:

I posted this before reading the last couple of posts. I guess the landlord reported him trying to get him out of the picture. What a scumbag loser.

Strange story, but it does sound like everything will be sorted out once he goes before the immigration judge.

The landlord is a bigger concern. It doesn't sound like there's any proof he's done anything aside from having designs on the wife, but this plus his access to the apartment would be enough for me to find a good hiding place for my important papers (lock box at the bank maybe) and even to install some sort of surveillance inside my apartment to see if anyone is really snooping around. Even a cheap, little sound-activated digital audio recorder might tell him something. I'd also rent a post office box and have my USCIS mail sent there, except that I'd be afraid of confusing USCIS at this point.

Not saying he is, but if he can prove the landlord is stealing his mail, that's a federal crime that he should report to the Postal Inspection Service. Their website, including a complaint form, is here: Postal Inspection Service

Or he could print up this poster and mail it anonymously to Mr. Landlord (or even just to the box number(s)) as a little food for thought: Tampering with mail...

Wow I can't believe this....this is crazy...for him to go thru this for no reason...when he had his paperwork...idk wats up with USCIS
