Hi, I'm sorry if this has been asked before. For the I-134 income requirement, must you earn NO LESS than the 125% as per the guidelines on the USCIS website (for a family of three $22000 gross) or is it that you need to earn 125% above this threshold? Thanks!

You have to make 125% OF the poverty guidelines set. 100% of the Poverty Guidelines is $17,600, so 125% of that is $22,000, which is the minimum that the petitioner/sponsor has to make.

Just when you thought it was safe...the guidelines will be revised UP on March 1 and the new minimums go into affect at the consulates April 1.

Your guess is as good as mine, expect a sizeable increase, I would say. More than the last few years. The government uses these to "show" how many people are "in poverty" and as justification for confiscating money from other people (taxes) to "fight poverty". Given the current administration, I would expect them to want to increase the number of people "in poverty" so they can confiscate more money and stimulate the economy by not allowing the people that earn the money to spend it to stimulate the economy, better to give to people in poverty to spend and stimulate the economy. Right?

Anyway the new guidelines will be put out March 1.

Question. Does the 125% requirement apply to K1's? I always thought the 125% did apply to K1 visas but this information from the U.S. Dept of State seems to indicate otherwise . . .

Since fiancé(e)s are nonimmigrant visa applicants, they should use the I-134. They will need to submit an I-864 to U.S. Citizenship and Immigration Services (USCIS) when they adjust status to conditional immigrant in the United States after they are married.

No. The 125 percent minimum income requirement, the most recent year's tax return and other requirements only apply when an I-864 is needed. Applicants using the I-134 will need to show that their sponsor's income is 100 percent of federal poverty guidelines as required under Section 212(a)(4) of the INA.
