Getting driving permit or license while AOS application is still pending

Hey everyone,

We came back from MDV office in FL today REALLY REALLY MAD!We are still mad and really need your expreince on this issue! I went with my huabnad today to do my written test and get my resticted driver license (driving learner's permit).

I came here on a K1 visa on July, got married August and submitted my AOS on October. My Visa and I-94 are expired by now.

At the begining, they said they cannot even let me do the test coz my AOS is still pending!!!!!!I insested till they let me do the test and I passed. Then I was surprised that though I passed the test they cannot issue me the driving permit!! What?!It's for God's sake it is just a restricted licesne!!!They seemed like they couldn't even use thier minds. They said your case is still pending. we cannot do anything till you get your AOS approved!Excuse me!!!

I made a search on the forum and was surprised to know that some AOS applicants who live in FL got ever thier driver license!!!!I made another search on the web AND surprise surprise based on florida immigration law website NOA1 is consered valid to apply for driving license and applications with pending applications are lawful for the issuance of driver's license!

I need your expreince and opinion on this!

Claudeth want to the DMV here to get an ID and they would only issue one with some sort of documentation from the USCIS. When she got her EAD they issued her an ID but only for the length of the Validity of the EAD. If you don't have any documentation from the USCIS concerning your status most institutions won't do anything for you.

Every state is different. We tried that too.. They did not allow me to take any test without any valid ID. the time i received my EAD everything went smoothly, took the written test, actual drive test.. and now I got my driver's license. just be patient..

Nov.24, 2008 - I-485 transferred from Chicago Service Center to California Service Center

Dec. 5, 2008 - Biometrics Appointment -- done

Dec. 8, 2008 - I-765 Touched

Dec. 9, 2008 - I-485 Touched

Jan. 12, 2009 - EAD card and Advance Parole Received

Jan. 13, 2009 - Applied for Driver's Instruction Permit

Jan. 15, 2009 - Driving written test passed

Jan. 26, 2009 - I-485 Touched

Jan. 31, 2009 - Actual Drive test passed "got my Driver's License"

Feb.25, 2009 - Took NCLEX-RN -- PASSED--- Anais,RN

March 9, 2009 - Green Card received

March 31, 2009 - Got a JOB!!! PCU nurse in the making...

Every state is different.

So true.. all I needed was my SSN and a legal photo ID (I used my own passport).

N400 Timeline:

12/14/11 - Sending out N400 package

12/19/11 - Received by USCIS

12/21/11 - NOA date

12/22/11 - Check cashed

12/27/11 - Received NOA

02/06/12 - Received yellow letter (pre-interview case file review)

03/13/12 - Placed in line for interview scheduling (3 yr anniversary)

03/17/12 - Received interview letter

04/17/12 - Interview - No decision, application under further review

04/17/12 - Biometrics

04/25/12 - Placed in line for oath scheduling (so I'm approved yay!)

04/27/12 - Received oath ceremony date

05/09/12 - Oath ceremony!!

Timeline

Virginia accepts the NOA1 to get the learner's permit, whether or not you have an unexpired visa. The actual driving license is valid for as long as your EAD is valid.

As o f 10-1-2008 Texas requires at least EAD or any visa/I-94 with at least 6 months remaining.

Did you show them your AOS NOA1? That's what they wanted from us.

I had the same pb in Louisiana.Damn!I printed out their regulations and I showed them all I need is NOA 1,because this is what it is said on their policy.But it didn't work.They just didn't want to read that paragraph about K1 visa...Afterall the supervisor came with an explanation:she said They need to send a form to USCIS to check my status....,because according to their regulations i'm not allowed to have a DL..even if like I said it's very clear in the regulations that noa is enough...anyway....I think I will just try at another dmv in another city in LA...I don't think it matters.where I live they ask me do to the driving school again even if I showed them my DL from RO...

Yes! I did showed them the AOS NOA1 and the EAD NOA1 but it was in vain!It seems from everyone's replies it's a common prob!!!!Do u think checking with another MSV office might solve the prob? I only need the DL for now so I can practice till can get my EAD or Green!!!At least doing something while waiting!!!

I wish I could have my EAD at least! My EAD is still in process though it's over 90 days now. I called and they said it is still in porcess, which sounds really wired to me coz I know u usually get them earlier than that!!

I got my learning permit same day very easy, they didnt even ask anything, i just gave them my SS card and my state id(that was issued 1 month before the driving test without a problem also).. i passed and thats all...

Some offices are concerned that we are illegal,i guess thats why try to have some of their "rules"..

Hello! Just got back from DMV today. I also didn't get anything. But unlike you I am expecting this to happen.

I read from their requirements that you need to bring (1)your passport with unexpired I-94 or bring your approved EAD (2) SS Card (3) Proof of billing (If not named after you, attached an authorization with whoever is currently living in the house)

So, it's either you apply before your I-94 expires or Apply when you received your EAD (which is to be fair with DMV they are asking for the document that is faster than AP and AOS to get approved).

I just didn't say anything to my husband so that he will take me out and since it's still early we might go to the mall or something :P

So, don't get stressed out sister. Let's just look at the positivity of things.

I am also from Florida and yes, I am using my husband's account.

They did the same thing with my husband when he came here. He took his permit test BEFORE his visa & I-94 expired and the expiration date on his visa turned out to be the expiration date on his learner's permit.

I didn't expect any less from the NYS DMV :wacko: At least you got the test over with & you passed... as soon as you get your EAD I would go up there and see if they will give you the permit. My husband was able to get his 'renewed' with the expiration date of the EAD as the new expiration date.

Don't forget that if this happens to you, remember to renew your license when you get your greencard. :)
