Hello,

I need questions answered please regarding a joint sponsor. I am going to need a joint sponsor. The joint sponsor does not live at the same household. The joint sponsor is married and filed jointly for year 2007. I am filling out I864 the questions are:

Does the joint sponsor use form I864?

Since he filed jointly which automatically includes the wife’s income, does his spouse also need to fill out the sponsorship form? Or just the I864 from the joint sponsor will do? This is a little confusing.

Please advice.

  1. Yes, joint sponsor must fill out an I-864, which also includes their tax return info.
  2. Joint sponsor's wife will need to fill out and I-864A since she is a household member of the joint sponsor. They can't consider the joint income unless they have an I-864A for her.

Thank you for responding. Well, the joint sponsor's income is in the six digits. If he does not include his wife's income for Q 24/part b and only counts his income from Q 23, will the wife still need to fill out the I864A? I'm trying not to delay this any longer as I already have his I864 ready to go.

You will have to include W2s and other supporting documents that show how much of the joint income belongs to your sole Joint Sponsor. The tax transcripts alone will not be enough in this case.

I would also explain this in your cover letter to avoid getting and RFE for an I-864A.
