Notes of advice:
- It took us 1 month to request Police records from the UK for the K-3 packet.
- They requested an I-134 for our K-3. They would not accept the I-864 as a substitute. They also required the originals, signed, and notarized. I got it notarized at a currency exchange for $1.
-Be sure to provide copies of your W-2 for that I-134.
We married in the USA while she was working here on a J-1 visa. We could have filed for AOS, but we knew she wanted to go home to take classes, visit family, and for a 2nd wedding banquet. We did not know how much time it would take to file the AOS and get Advance Parole, so we decided to go the K-3 route instead. Classes were only 2 months, so in hindsight, it would've been better to do the AOS first. I don't think the AP takes as long as the K-3. |

First RFE was for the Birth Certificate. In Taiwan they have 2 types... we submitted the one that looks kind of like the U.S. birth certificate, which was wrong. They want the one from the local government office, NOT the one that the hospital gives you. Also, they wanted 1 copy of the original, plus one translation copy. We are getting the translation done professionally as the rules appear vague to us as to whom can be the translator.
After receiving the RFE on the Birth Certificate, it took us about 2 weeks to get it translated and ready to send back. Missing info submitted 2008-10-20 for RFE. They received it 2008-10-24.
90 Days passed since the processing resumed after they received our RFE, so we contacted them (phone) to report a problem. About 10 days later we received an email saying that they were printing the EAD card. Card received.
Second RFE came at the interview. They never received the Medical Exam after we surrendered it to the airport upon arrival on the K-3. They said they could try to track it down (2-3 months), or we could do it again and submit it with an RFE. We're doing it again. They also wanted more evidence of relationship (401K beneficiary, and proof that she's covered under my medical insurance). We brought a lot of stuff to the interview, but they only asked for a select few items.
Sent stuff in USPS simple certified. Received approval 3 weeks later. |
