Comments : Had the interview on Oct 16th, 2023 at 7:40am. We were approved and now we are waiting for the visa to be sent to the consulate near us.

Update: it took only 3 business days for the passport to arrive at the consulate near us for pickup. We then entered the US on the 13th of November after our two year anniversary so that we could be issued an IR1 visa instead of a CR1 visa with conditions and having to go through this whole process with the USCIS again in 2 years. Now we are just waiting on the physical green card to arrive in the mail. We received the social security number 1 week after arrival in the US. But with the passport with visa you are able to work and get state IDs and all that jazz.

Update 1/26/24: His green card arrived on Saturday but it has the wrong category. It says CR1 instead of IR1. We entered the United States AFTER our two-year marriage anniversary so he should have been issued an IR1 visa, 10 year green card and he wasn't. I filed an I-90 to get this corrected but I'm not sure how long this will take. USCIS website says the average processing time for an I-90 is 23 months??? His green card will expire before then if it truly does take the 23 months to process. So we're kind of in a limbo right now trying to figure out what to do next, but also twiddling our thumbs waiting for something to happen.

Update 2/23/24: A week after we filed the I-90 we got a letter in the mail letting us know that we had an appointment on the 6th of February at our local USCIS office. We went there on the 6th and they took his fingerprints and a photo and told us that we should be receiving an updated green card in the mail soon and that once we got the new green card, they would ask for the old one back. On the 21st we got an update on USCIS that his card was being produced so now it's just a waiting game to see when it'll come in the mail and if they actually corrected the visa category on there!

Update 03/12/24: His corrected green card arrived in the mail yesterday and this time it was actually correct. Showing his IR1 visa category. So now everything is correct!

Comments : Took my husband to a back room and made him sit down. Then everyone left and about 5 minutes later an officer came back in and told him he was approved. Didn't ask him any questions or anything, just made him sit down and wait. The only thing that took long was the actual customs line to see an officer, was super packed at 5am!

Event Description

Embassy Review : Our interview time was at 7:40am however like most things in Brazil, no one cares about your appointment time and it's first come first serve. We arrived about an hour early, 6:50am and there was already a massive line for tourist visa people and on the other side of the street, about a 8-person line for immigration. We sort of stood around there for a few minutes because our slot was only at 7:40, however based on our experience at the ACS fingerprinting place where it was a zoo, we figured it wouldn't hurt to pop in line with the rest of the immigration people. Fast forward to 7:10am and now they're letting people in and no one looked twice at my husband and he was the 10th person inside the embassy.

The Staff: The attendants are rude, it's simply who they are. They're rude at the fingerprinting place, they're rude at the embassy. You just have to be nice to them regardless.

The People: The people who are in there with you are also rude? It's like they're all chickens with their heads cut off and running around. They skip you in line because they think they're more important, they throw their papers at the staff and ask them if they have everything. Even though they give you a piece of paper with all the documents you will need and the specific order to sort the papers in order to advance to the interview. People have no sense of personal space and some lady even kicked my husband while waiting.

The Interview: The actual interview took less than 2 minutes, they asked my husband 5 questions and he was on his way.
The Questions:
É o primeiro casamento seu e de sua esposa? (Is this your first marriage)

Você já esteve nos Estados Unidos ou já viveu em outro país? (Have you ever been to the U.S. or lived in another country)

O que sua esposa faz? (What does your wife do for a living)

Quem é "Bob"? (Who is "Bob")
*"Bob" is my dad who is our co-sponsor

Sua esposa já te visitou após vocês casarem? (Has your wife ever visited you here after you married)
*The interviewer didn't realize that we have lived together in Brazil since we got married. My husband clarified that to him

That was it, he handed my husband a paper with some info saying "You're approved" and a link to track the passport.

Overall it was a decent experience, we arrived at 6:50am and he got out at around 9:00am. It would have taken him less time but he had many people cut in front of him during the separating the papers stage. Your appointment time doesn't matter and if you just get in line no one will care. So now we're waiting to pick up his passport at the consulate near us!

Filling online I 90 ?
blank avatar Juliagus on 2024-03-21 said:
Yes we filed the I-90 online to get a corrected green card. We paid no fee as this wasn’t something that was our fault.

I have same situation cr1 instead of ir1 after second anniversary poe When I fill I 90 online so first question is What is your current immigration status? Getting Started Lawful permanent resident Permanent resident in commuter status Conditional permanent resident Which one is true?
blank avatar Juliagus on 2024-03-22 said:
You’re a lawful permanent resident, since you’re supposed to be getting an IR1

So I was issued the immigrant visa under the Conditional Resident (CR1) category(passport stamp cr1 and CBP officer stamp cr1), but I will be entering the US for the first time after our 2nd anniversary. Will I get a 10-years green card?
blank avatar Juliagus on 2024-03-22 said:
If you are entering after your two year anniversary then you should be issued a 10 year, IR1 category green card. If not, just file an I-90 to get a replacement. But wait until you receive your green card first, don’t file the I-90 until you get your green card and if it has the wrong visa category.

Okay so you got your green card and it’s wrong so you need to file the I-90 and wait for USCIS to get in contact with you. Don’t pay a fee.

Will I get 10yr green card?
blank avatar Juliagus on 2024-03-22 said:
Yes you will get a corrected green card to match the correct category of IR1. It’s 10 years

*Notice about estimates: The estimates are based off averages of other members recent experiences
(documented in their timelines) for the same benefit/petition/application at the same filing location.
Individual results may vary as every case is not always 'average'. Past performance does not necessarily
predict future results. The 'as early as date' may change over time based on current reported processing
times from members. There have historically been cases where a benefit/petition/application processing
briefly slows down or stops and this can not be predicted. Use these dates as reference only and do not
rely on them for planning. As always you should check the USCIS processing times to see if your application
is past due.
