RFE for police clearance certificates due to inability to get good fingerprints. Note to anyone reading: if you have to do fingerprints twice, save yourself the frustration and get police clearance certificates from everywhere you (the petitioner) have lived for the past 5 years. Make sure they are translated. That will be the difference between an RFE at your interview and a decision. |

Our K1-->AOS interview occurred on March 30, 2023. After checking in and doing yet another round of fingerprints, we sat for maybe 15 minutes before we were called to the back. It turns out that none of our biometric appointments yielded usable fingerprints, so we were initially concerned when we were asked to sign a witnessed statement that revolved around criminal acts, but it turns out that if they can't get fingerprints then they will make you sign this form and retrieve police clearance certificates for all locations at which you have lived for the previous 5 years. Unfortunately, you will only learn this during the interview so they will be unable to approve or deny you until you get an RFE for the police clearance certificates. Beyond that, the interview was surprisingly simple. We were only asked very simple questions regarding the relationship - what's your spouse's birthday, how did you meet, what are the names of your spouse's parents, etc. The immigration officer never asked to see any pictures or evidence besides our driver's licenses. I really can't say if this is because we already 'proved' our relationship at the K1 stage or if this immigration officer just didn't feel like he needed to ask many questions. My only knock against the process is that it would have been nice to know about the biometrics issue so that we could have prepared the police clearance certificates in advance. Our RFE appeared in our account the same day as the interview, we sent the response early the next week, and we were approved 10 days after they allege to have received our response. . |

Timeline Comments: 5When did your petition get to the uscis? They received my petition on November 2 still waiting on the receipt
We sent it on October 22 and it was finally received on October 29. The check was cashed on December 4, but didn't show up on my account until December 7. Once I saw that the check was cashed, I called USCIS and they confirmed that I was in the system. They gave me the receipt number on the phone. I still have not received the formal NOA1 in the mail, but I did receive the text message from the G-1145 on the evening of the 7th.
Based on other posts in the October K1 filing thread, filings from my week received notification about 2 weeks after folks that filed the week prior to me. I don't know why there was a delay, but other folks from my week received their receipts around the same time as me. Hang in there - you will receive it soon!

Hello Gauchos. I saw that in the california timeline you appear as Noa on December 14th, but reading your comment above, I see that this is the date the check was cashed, but not the date of receipt of your noa 1. yes , you looked at your # 1, you will see that the true date is approximately October 29 when they received their application. If you look and correct, the times will also be corrected. since you are from October and not December. 😉

Hi Ambarpatt1 - I've updated the timeline. Yes, the date they received the application was October 28 according to their receipt date, though they did not acknowledge it until December 7. The NOA1 actually had both dates on it. At the time, it wasn't clear that they were going to refer back to the October date. It looks most others on the site are using their October date so I've updated it on my timeline. Thanks for the heads up!
