Comments : We aren't using this visa application any longer. In september 2007 we came to the USA together, as tourists for a few months, considering how long this was going to take. We were going to move to Canada and change filing consulates because Kosta could work there as an Aussie, and I could maybe find work too. When we entered the US (him on the visa waiver program) we spoke to a lawyer (several actually) and got advice to marry and stay here, because filing through Canada might be difficult. So we got married in November 2007, and I spent a month preparing the packet to save money.

Then we submitted that just before his I-94 became invalid, on Christmas eve. We are now filing I-130/I-785/I-485 AOS, waiting on his EAD so we can finally BOTH work.

Comments : After our interview we were told we were "recommended for approval" However 6 weeks later we finally received notice that the card production was ordered. We had an infopass appointment about 4 or 5 weeks out and they told us that we had multiple case files that had to be consolidated, and our case was sent out somewhere to be consolidated, and at the 5 week mark it was just being mailed back to Baltimore. We wrote a note from ourselves and got a note from the clerk to send to our immigration officer pleading her to look at our case sooner rather than later when it was returned to her, seeing as we wanted to book our honeymoon in September after our public wedding, and we would be so upset if we couldn't go because our case was put at the bottom of the stack!

Comments : Our EAD was touched on 2/25, but we waited patiently for it to be approved. Finally I gave up waiting and made an INFOPASS appointment for 3/17/08. Kosta was told his biometrics paperwork wasn't completed properly and therefore hadn't been sent onto his EAD which was "awaiting biometrics approval". Ironically it had been approved and sent in for his 485, which is why we had received the interview date for that already! So he went in and had to re-do his biometrics, and within 3 hours, the status changed from Pending to EAD Card Production Ordered. Don't be patient! Go get answers at infopass! He could have been working for a whole month earlier! GRR
