Our case: AoS from H1B to GC based on marriage to USC. See timeline for more information.
We took the following things with us:
Me: BC from consulate, passport, I-94, originals of previous H1B approvals, originals of previous I-20s, photo ID, EAD, AP
Wife: Original BC, photo ID, letter from employer (she changed jobs after we submitted I-485 package), six months worth of pay stubs, W2s and 1099s for 3 years, new affidavit of support (I-864)
Us: Certified marriage certificate, lease, bank statements, letter showing she's the beneficiary of my health insurance and disability insurance, wedding photos, letters from my parents and her grandma addressed to us, copies of our original submissions (I-130 package, I-485 package)
We parked in a garage right in front of the fed building in downtown Cincinnati. Security was quick. We were in the waiting room at 10 AM and put the appointment letter in a box at the window. There were about 20-25 people waiting there.
Our appointment was at 10:30 but we didn't get called till noon. The IO who interviewed us was very friendly, professional and apologetic about the delay (which was apparently caused by a shortage of staff that day). After we were sworn in, she asked us for our IDs. Then she asked me my name, address, place of birth, whether I was previously married or had children, when I first came to the US, whether I had ever overstayed my F1 or H1B visas, and then the "no questions."
She then asked my wife her name, address, place of birth, whether she was previously married or had children, whether she had ever filed an I130 for anyone else. Next, she asked my wife how, when and where we met. She wanted to see evidence of our marriage at which point I gave her our financial documents and the wife pulled out the photos. As she looked at the photos, she asked about who was present at which of our "weddings" (Long story... we had 3 weddings. One legal in front of a judge, one for her family here, one for my family in India.) We also showed her the letters from family.
I then gave her the new I864 we had filled out, but she said it wasn't necessary to fill out a new one, she just needed the new payslips. Another interesting thing: she never asked either one of us for the BC.
The whole thing took about 10 minutes. She finally said that everything was fine from her side, but that my background check wasn't back, at which point my heart sank. We thanked her for her time and she led us out.
Ladies and gentlemen, the dreaded name check blackhole has a new victim and his name is DL Austin. |
