Comments : Husband was denied under section 212a as being deemed a public charge His appointment was at 8:30. The lady called him to the desk and ask for his papers She also asked him if we had a joint bank account. When he was called for the interview the interviewing officer looked at his paperwork and told him that he was going to refuse his Visa because he is considered a public charge because my bank statement that I sent to the NVC shows that I did not make enough money to sponsor him. But in fact we had a joint sponsor so it wasn't based on just my income alone. We also had my update bank statements showing that I make five to six thousand a month now starting in February which is why we had a joint sponsor in the beginning because my daycare didn't fill up until then. He says the officer didn't want to look at my new bank statements or consider my cosponsor. I'm not accepting this. The man was very unfair. How can you deny when the evidence is there.

KayG my household size with my husband included is 7. My joint sponsor has never sponsored anyone before. I sent the same documents to the NVC that I sent for myself. Tax transcripts and tax returns, W-2 etc. The interviewing officer wouldn't even consider my cosponsor he just told him your wife doesn't make enough to sponsor you. He wouldn't look at my bank statements or even give him a chance to respond.

I also had a refusal base on public charge. I had submitted a new joint sponsor who met the poverty guideline he is single and he has never sponsor anyone.i had submitted every pieces of docs from the joint sponsor after the submission I was called by the embassy to come back and the visa officer said I’m still going to be public charge. We hired a lawyer who help us to gather docs which is my wife bank accounts ,current employment letter, her parents income, her parents ids and earning statements and social security statements I had submitted those docs in August 2 2018 I haven’t heard anything from the embassy right now I’m still waiting on their response

*Notice about estimates: The estimates are based off averages of other members recent experiences
(documented in their timelines) for the same benefit/petition/application at the same filing location.
Individual results may vary as every case is not always 'average'. Past performance does not necessarily
predict future results. The 'as early as date' may change over time based on current reported processing
times from members. There have historically been cases where a benefit/petition/application processing
briefly slows down or stops and this can not be predicted. Use these dates as reference only and do not
rely on them for planning. As always you should check the USCIS processing times to see if your application
is past due.
