Event Description
Review Date : December 15, 2019
Embassy Review : Arrived at 8am for 8:30 interview. Went to the guard at the front of the line and advised we were there for Permanent Residence Visa, they sent us to a window (outside). There, we were handed a green folder with a paper attached to the front outlining all the documents that needed to be placed inside. Then we went through security. Then to fingerprinting, then told to go straight inside and be seated and wait for name to be called. We were called to window 5 which is in a small little room with a door, completely apart from all other windows. The lady behind the glass was straight faced but nice, she asked for all the documents one by one that we had in the green folder. Then we were told to be seated back in the waiting room and wait for my husbands name to be called again but to be prepared to wait for a while because all documents needed to be scanned into the system. One of the items on the list was evidence of our marriage, I had about about 2 inches worth of evidence so this was gonna take a while. We waited 2 hours, then he was called back to the same room, I, the spouse (petitioner) was not allowed to enter the room with him that time. He was interviewed for 45 minutes, what seemed like eternity. We already knew the outcome of this interview. We have a I-212 waiver pending at NBC because my husband was expedited directly from airport back in 2017. The CO officer was very serious but very detailed and did apologize that he could not issue the visa at this time until the waiver is approved. He gave us the denial letter stating the requested 212 waiver. Overall, it was a very stressful experience, the embassy is well advanced compared to what I’ve read about other embassy’s. The Medicals were all completed in 1 day and no envelope was given, everything was sent to DOS electronically. The CO also stated the same would be once the visa is issued, no folder will be given. Now to wait for the waiver approval.

Thank you!!! It’s been one wild journey! Once I received the approved waiver in the mail from uscis, I emailed the embassy and attached the approval and advised him that his Medicals were about to expire and because of Covid we didn’t want there to be a delay. 1 week later on 5/29/20, the CO from the embassy actually called me, I couldn’t believe it. He said he called because it’s so close to the date that they didn’t want to chance that we wouldn’t see an email from them. He advised that all Medicals Exam appts have been suspended at this point because of Covid. They asked him to be there wed, 6/3/20. When he arrived, everything was processed at the window outside, they are not allowing anyone inside the embassy. They told him he was already approved for the visa and didn’t do an interview, they just asked him for his passport and a copy of the waiver approval and they would call him to pick up the visa. They called him 4 hours later, he got there and they handed him the passport back With the visa inside and said congratulations and good luck. I am completely impressed with the detail and urgency the embassy handled everything. I applaud them to the fullest!! They could have allowed his Medicals to expire, but they actually put the effort in to make sure his visa was issued on time and even told us to book the flight that is leaving before the Medicals expire. He flies out this Friday!! It’s been a long depressing 3 years and I am forever grateful to this embassy for doing everything they did for us to make this happen in less than a week!

You’re so welcome. It’s been a very long journey. So many bumps along the way, but the one thing I maintained was patience. I can’t begin to express how important that was. Just knowing it would eventually all come to a end. And the BS embassy, VERY satisfied how they handled everything!!! Good luck!!!

Hi there! I noticed our husbands had the same reason for removal (212a7aii) at the airport. I'm in year 6 of my immigration process and waiting for his interview hopefully this year! I read your husband was denied at his interview until his 212 waiver was approved. Is a waiver necessary if he would've waited out the 5 year ban? Or it was only necessary in your case because your husband wanted to re-enter the US before the 5 year ban was complete? Thanks so much for sharing your story and for any advice you can give :)

Hi Torito, No, If his ban was 5 years and it’s been 6, no he will not need the waiver. As long as he has all his documents at the interview, they should approve him right there. Because of the pandemic, I have no idea how they are handling the issuing of the visa. Because everything was rush rush with my husband, they gave it to him there at the embassy the next day! I am happy to hear your process of almost to the end...good luck!
