Comments : Mike was denied because of a tiny marijuana conviction from 15 years ago. We hired an immigration lawyer in the US, we created and submitted a Waiver application to waive the conviction in this case. We had to prove 3 critical elements, that the conviction was 15 years old (pure luck that it was, by only a month!), it was Marijuana only, and that the amount was less than 30g. At the same time, I was working with my Congressman's aid to request an expedite to my waiver application. The stars aligned and just a few days after submitting the application we were notified it was approved by DHS! We were expecting another 6-12 months of waiting for the application to be reviewed and it went through immediately. I'm so grateful to whoever pushed that through.

*Notice about estimates: The estimates are based off averages of other members recent experiences
(documented in their timelines) for the same benefit/petition/application at the same filing location.
Individual results may vary as every case is not always 'average'. Past performance does not necessarily
predict future results. The 'as early as date' may change over time based on current reported processing
times from members. There have historically been cases where a benefit/petition/application processing
briefly slows down or stops and this can not be predicted. Use these dates as reference only and do not
rely on them for planning. As always you should check the USCIS processing times to see if your application
is past due.
