Embassy Review : |
My husband (intending immigrant, he is disabled with Cerebral Palsy and in a wheelchair) and I arrived at the US embassy a little after 11am, and waited outside until 12:30pm for his 1pm appointment. There was no tent set up but one girl at a podium, so we checked in with her. She looked over our passports and interview letter (only) and we were passed over to the security building where they did the same again. We went through the security hut and they had to swab his wheelchair for explosives. Once through we were handed over to another lady who operated the wheelchair lifts for us. We got our appointment number, i909. We waited in the big, warm room (with big loud fans) for about 30 minutes where we were called to window 13. The lady asked for our interview letter with tickets (given at the front desk) and his uk passport. She then asked for his uk birth certificate, our marriage certificate, and his police report. She then asked for copies of all those. Then, we waited a bit for her to get his file and assemble the papers. She then asked for a passport photo (and later another), and then the affidavit of support. I handed her mine (USc petitioner) with my last tax return, then his joint sponsor's with his last tax return and a letter from his employer. She assembled all this and then asked for his fingerprints. At this point I should say that my husband is in a standard wheelchair and the counter had a ledge at standard standing height. He was unable to stand and couldn't reach the fingerprint machine due to his disability, so she suggested we try to pull it closer, which caused the machine to disconnect. We waited for a bit to see if someone could fix it, but ultimately tried another window with a lower ledge. Apparently there is a problem where people don't logout of their terminals and then another person can't login to the computer at the terminal...it eventually got worked out though. They have two windows that have ledges wheelchair height (and apparently not all the CO's are aware of this).
So, we went back to the waiting hall and waited for about 15-20 minutes when we were called for our interview at window 15. There was an American woman being supervised by another lady and she smiled and was generally friendly. She said are you Thomas? He said yes. She said I'm going to ask you to take the oath, which he did. She then said I (his wife) was welcome to stay but she would be directing questions to Tom, but if I wanted to add/clarify I could. Conversationally, she asked who I was, who our joint sponsor was, if he (the joint sponsor) would be taking care of us (I said until I can find work) and she asked what I did, I answered a nurse, and she said right, but you're caring for him full time so who will take care of him? I said my mom will be able to help. She said is your mom a nurse? I said no, but I can show her what needs doing. I then said, Tom is also able to work from home. He explained he was a trained translator and interpreter. She smiled and said oh good! She asked if he'd ever been to America and he replied no. She said wow, and then she asked if he'd ever lived out of the UK for longer than a year. He mentioned he had lived out of the country (in France and Spain) but for less than a year and it was for work experience for his university degrees.
She flipped through his file and glanced over the notes the doctor took at the medical and the various doctor's letters we gave to them which were all included in his file. She said, so you are going to get health insurance? I said yes, we have already gone on the Marketplace and got quotes, and registered with an insurance agent. She asked Tom if he planned to get surgery? He said no, we know what we're doing with the situation as it is and that's good enough for him. She asked when we were leaving and why he wanted to live in America (he said quality of life with a brief explaination). She asked if he had ever met my parents or if I had met his. She asked when we got married and how met, and on what kind of site? After a few minutes of her typing into the computer she said, okay, I am satisfied with this information and am pleased to tell you that you've been approved!
At which point I cried.
We were there from 12:34 until 3:30PM. There were 21 other immigrant visa applicants that day. She said it would be 2 weeks until we received our visa--so starts the CEAC checks!!
To anyone reading this looking to get a IR/CR-1 visa for their disabled spouse, DO expect more questions. Rehearse your answers but be honest. Be confident. Do your own research and plan ahead for any foreseeable problems because the CO will as about things. *Notice about estimates: The estimates are based off averages of other members recent experiences
(documented in their timelines) for the same benefit/petition/application at the same filing location.
Individual results may vary as every case is not always 'average'. Past performance does not necessarily
predict future results. The 'as early as date' may change over time based on current reported processing
times from members. There have historically been cases where a benefit/petition/application processing
briefly slows down or stops and this can not be predicted. Use these dates as reference only and do not
rely on them for planning. As always you should check the
USCIS processing times to see if your application
is past due.
