Okay, So the interview was scheduled for 10AM. we arrived an hour early because there was a line. we waited in line for about 20 minutes and then we went through the security check point and were told to go to the 14th floor.upon arrival i met up with my attorney and we checked in around 9:30. My husband was super anxious and couldnt sit still. There was no where to sit so we stood for a while until they make people whom didnt have interviews go and wait on the 3rd floor. about 2hrs and 45 minutes passed before i went to the AOS window and I asked the lady( older woman, rosey red cheek, a bit on the heavy side) how long it was gonna take because i had to be at work by 1:30. she said oh let me call your IO and see if she can take you now and then she said oh you have a wonderful IO..she is strict and she checks everything if a hair is out of place but lucky for you she is in a good mood. While i stood there she called and was told that she could take us in 10 mins. After about 30 minutes our name was called. The IO apologized for the delay stating she just finished a fraudulant case and was speaking with ICE. I swallowed hard because i thought OMG.....
After reachiung her office she swore us in and then she asked me to translate for my husband( he doesnt speak english)(which i did). when we set down she said so........( long pause for probably a minutes or 2) you have been married 4 years. (me) mm-hmm...(her) so why didnt you file for conditional card previous? (me) well to be honest ma'am we didnt file because we didnt have all the documents need and I was a pre med student so I wasnt working full time.(her) did you bring proof of this. ( i handed her the records and proofs). Then she asked: do you have joint accounts together( i handed her the accounts) she said I am going to keep 2 statements for your file. then she asked my husband have you ever been arrest.(husband): no...(me) yes he was....(lawyer) gives me a look of why did you just say that. She said to me explain. (me) well in 2008 we was stopped for driving on international license and they sent him to 10 days jail but we faought the case and paid 4,000 dollar fine. (her) do you have the certified dispoitions. (me) yep here they are. (her) oh kay. theres no problem because this is civil.
(me)okay.
(her) so I am going to approval your I-130 but not the i-485 because i cannot prove your husband entered the country legally.
(me) heres the passport stamp and biographics page
(her) because of the amount of fraud associated with the and the fact that colombia is a high fraud country USCIS no longers accepts just the passport and stamp. you must apply for I-102.
(me) we did. she said okay let me check.
(her) it hasnt been processed yet
(me) i know and its been 6 months
(her) pondering what i just said
(her) okay well I am going to hold your case until I can call around and see what I can find but if you dont get something to prove he entered legally by 06/29/2012... I will have to send your case for denial.
(me) what...omg...omg... i followed the rules i applied.VSC is not proccessing my form and I will be denied. I dont have 1,070 to do this again
(lawyer) We can all go to immigration court
(her) Theres no need for that if i can found some proof or if she can find some proof
---- the argued for 30 minutes or so----
she gave me a sheet of papers explaining what happened and thanked us. before i left she said.... dont jump off a bridge just yet and winked at me. I didnt understand what she did that for and 2 days later I get the card production email.
I believe she was hard on us because of the country he is from. BUT please people do not try to use passport stamp as that is no longer acceptable at USCIS offices. according to the IO and USCIS via phone. only time they will take it is only when you have already applied for I-102.
We didnt show any pictures or leases or anything really, my BC,his BC and Marriage License and Joint Accounts and school records. thats it. no pay stubs. I did give her a flashdrive with photos but she gave it back.
Overall...it was smooth. she didnt ask anything to my husband expect. how did you meet your wife and when did you know you wanted to marry her.
I hope this review helps. thanks everyone on March Filers 2012 for all the help that you have given to me and my husband. Special Shouts to ChrisPG,MsNotBonJovi,Avi30,Georgeramsaran,Alejandra,Nene815,Mike X,Dri Au Pair,Immig?,Arce,BritWill,Uscisb1...( you guys have gotten me through the rough spots and I just wanna say thank you for all the advice and support) if i forgot anyone sorry thanks to you all too and everyone else on VJ that has offered me advice prior to filing our AOS.

Timeline Comments: None yet, be the first!
*Notice about estimates: The estimates are based off averages of other members recent experiences
(documented in their timelines) for the same benefit/petition/application at the same filing location.
Individual results may vary as every case is not always 'average'. Past performance does not necessarily
predict future results. The 'as early as date' may change over time based on current reported processing
times from members. There have historically been cases where a benefit/petition/application processing
briefly slows down or stops and this can not be predicted. Use these dates as reference only and do not
rely on them for planning. As always you should check the
USCIS processing times to see if your application
is past due.
