Posted July 8, 2017 · Report post Hi guys, good day! Hope you are all pushing through with your visa application journey through DCF mostly the February 2017 fillers. Anyway, our good news is by God's grace, guidance and all your prayers and informative comments, FINALLY my spousal visa /IR1 is already approved and issued. Yesterday's interview went well after a long scrutinizing questions from the american consul. So, not sure if somebody from this group went there yesterday, but saw some families also. Let us know how is your visa processing going on and will gladly share our experience and all the papers we provided. Will share it in our family blog. God bless you all. All the praises and honor belongs to Jesus Christ, our great provider of wisdom. JEREMIAH 29:11-14 NEW LIVING TESTAMENT 11 For I know the plans I have for you,” says the Lord. “They are plans for good and not for disaster, to give you a future and a hope. 12 In those days when you pray, I will listen. 13 If you look for me wholeheartedly, you will find me. 14 I will be found by you,” says the Lord. “I will end your captivity and restore your fortunes. I will gather you out of the nations where I sent you and will bring you home again to your own land.” 2017-07-18
ARBIGRED1 D & L Jamaica Vermont No Jamaica 2016-09-14 2016-09-15 2017-03-14 2017-05-01 2017-06-23 2017-06-28 2017-06-29 2017-07-14 2018-04-17 2018-05-03 2016-07-05 303* We had completed the NVC process and had sent our documents to them. We know they were scanned in. But it was an 11 week wait and I need bi-lateral hip surgery so we requested expedition of our Case and we're approved on 06/20/2017 applied on 06/14/2017. Interview date received 06/29/2017 and set for 07/14/2017. Medical exam set for 07/03/2017 My husband with for his first interview and was denied and given instruction to apply for a 601 waiver for inadmissible due to a CIMT . We knew of the simple Larceny charge which was 16years old and understood it would fall under the exception rule because he never served any jail time and nor was he fined. The simple case had a monetary value of less the $200 USD. He was convinced to plead guilty to a charge he didn't commit because his family could not afford the legal fees it would take to fight the issue before a judge. After reading things I felt it was a 60/40 shot that we wouldn't have to file a waiver. We lost the gamble but it allowed me the time I needed to collect the money for the $930 fee. The waiver won't be easy to complete as you have to show more than the average cause of hardship. However he is in Jamaica which is a country trying to build itself but is decades behind the USA in healthcare, jobs, etc. Most are struggling farmers. So providing the necessary information of how it would be a dramatic loss to us maybe a tad easier in comparison to if he lived in another country. We also had to provide more proof of our relationship and had to submit our personal text messages and email. Frankly I think it is an invasion of privacy but we all know we must comply with the rules. Because I'm in need of a double hip replacement I've been unable to travel to see him so we had not seen each other in a years time. My advice based on all of this...go ahead and do the waiver in advance even if you believe you can fall under the exception rule...they will fight you on it. Also..do all u can to visit your love one more than twice b4 applying. It will build a stronger case. I learned all of that on here but I didn't find this site until after our process was underway so...we had to go with it and be prepared for them to come back at us and we are/were. I don't make enough money to hire an attorney to help. But if you have that option and u have a CIMT...get an attorney to help you! Even if the case is 16 years old...and simple...petty...a misdemeanor they will hold it against you. My husband crime doesn't even show on the police report. He would have been 20 years old he's now almost 37 and never had another incident with the law. He said the girl that interviewed him was probably mid 20s and she was already set to turn him around...she marked on her paper and shoved it through the window and said you will have to reschedule after you get this stuff..he looked at the paper and everything she marked he had in the folder with him. So she had to take the paper back and scratch out stuff...she did that different times and each time he had what she needed. How about asking him instead of assuming save all of us time. Thing is...she was full of crap when she said she didn't have the paperwork...she had all my tax stuff but the current year..laughable when I loaded the paperwork I started with the most recent year back so if she had all the others she had that one first. That's just an example if the tricks some of them pull and Glory to The Most High I read and got his folder ready for all that she was throwing at him. I believe in protecting our borders...but I think the should be held to a standard when reviewing these cases...it should be illegal for them to pull tricks like that. No I did make a mistake because I kept a copy of what I sent them in the exact order I sent it. I scanned it to the computer just b4 packing it up. I had the IRS to send my tax transcript before I mailed the packet to them..so she flat out lied. 601 waiver approved 01_31-2018 2021-03-11
