Review Topic: IR-1/CR-1 Visa

Ok, so here's the skinny.

I am writing this on behalf of my wife and daughter who were approved for CR1 and IR2 visas respectfully.

We had lived together in the Cayman Islands for over a year. They are Honduran nationals. We were married for over a year as well in a Cayman civil ceremony. I was told initially that a direct consular filing was possible, but unlikely to be approved. The embassy told me that it would be in my best interest to re domicile myself in the states first and then apply. So that's what I did. I started the process in February of this year.

They were approved with conditions that I provide an additional joint sponsor for our daughter who is 8 years old. A couple of things wrong with this. First, according to US law, a person who is eligible for a visa that will automatically make them a United States Citizen upon arrival in the country doesn't even need an I-864 from me let alone a joint-sponsor. My wife on the other had been approved with just my I-864. Second, they were told that since my income was "over seas" income for the year 2010, they would not count that tax return, because I did not pay taxes. Well, according to IRS and Federal law, I didn't have to. But I did report the income and file my taxes. Another mistake on the part of the interviewer. Lastly, I work 3 jobs. 1 full-time county employee job that puts me at nearly $10,000 more than required for a 3 person household at just my base pay. Not including shift differential, weekend, holiday, over time, and order out pay. And that also doesn't include my other two part time gigs. So the interviewer I believe was wrong in that respect as well.

But instead of fighting the system, which would likely take longer, I gave them what they asked for via FedEx to my wife the very next morning 02 NOV 2011. She received it on 03 NOV 2011, and the embassy in Kingston received the joint sponsor information as well as their passports (the interviewer was kind enough to not have to make them travel back to Jamaica a third time) at around 3:30 on Friday, 04 NOV 2011.

I received confirmation today that their passports will be printed on Monday, and either be turned over to DHL later that day, 14 NOV 2011 or the next morning. In which case my wife and daughter will receive their passports the very next day either Tuesday or Wednesday, which is when I'm arriving to pick them up. We will be heading back to the US on Friday, 18 NOV 2011.

Praise God!
