Review Topic: K1 Visa

My fiance had her K-1 visa interview yesterday. She said the consular officer was predetermined to deny her application, she heard him talking to others saying "this one is going to have to do it all over again". He would not let her get a word in, and made fun of the fact that I hadn't visited in 8 months, implying that I wasn't serious. He also asked why she responded to my profile on a website, implying that she was just looking for a USC, and that her intentions were fradulent. Then he pointed at the "wedding" pictures, which we clearly stated in a cover letter were not from a marriage legally recognized in India (see my other posts for more details on this) and that we only provided to show proof of a valid relationship. He said it constituted a marriage and told her to have me come back to India, marry again (properly this time), and reapply for a K3 visa! He did not seem to understand that we couldn't apply for the K-3 because the original marriage was not registered.
Finally, he convinced her to sign an affadavit stating that the marriage is legal and that it would be better to restart the process rather than wait and appeal. Which may be true but I would have liked to have the opportunity to speak with an attorney before doing this, and since she couldn't call me (cell phones aren't allowed inside) I was unaware until after he had denied the visa. So now we have to start all over again. Another 8 months, yay
