According to the State I am living, she has 90 days to show the progress of status change application (I-797 for biometric appointment with the finger printing DONE stamp) to keep the driving license WITHOUT taking the the whole process again if she acquired it before I-94 expires. However this policy could be totally different. Check your state office and the will let, but you should find the NOT busy office to get the whole explanation.

  2. What is the usual reason for administrative processing? and is there a standard of amount of time that is usually allocated for this? My Fiance was told to keep phone on because they will be calling.

    AP could be for any reason the IO believes that there is some sort of further investigation. And also depending on the reason, the time will vary from few days up to years. My fiancee was under AP for 28 days. She was interviewed in another country , so that they want to check some stuff from her original country. The only thing she has to do is to wait for the phone call or an email from the embassy. Did they kept her passport? If yes, they might simply send her passport with the visa when they are done with the AP. However you can call DOS and check the status of the AP.

  3. I think your I-129f application is denied at the USCIS level. So you don't need to do anything, just refile another one with the appropriate documentation and fee. If it was approved and the embassy denied the visa, it will be totally different story. That was what to my fiancee. I did the whole thing again and got a lot more things to do with the paper work. Just make sure that you include the whole evidences.

  4. just give me an idea that is it possible AS IN OUR CASE we met online, and then filed the case, never met ion person .she was not willing to come to pakistan and i just kept it on apropriate method insted aplying for a visit first and then K1 NS SO ON

    Meeting in person is the major requirement to get approved at the USCIS level. Unless you have a convincing financial hardship or cultural reason prohibiting you to meet your finacee, it will be really impossible to get approved.

  5. Hello everyone, here i am again asking questions.

    I'm getting married next month in Mexico and filing soon after. I am a Naturalized U.S. Citizen, born in Tijuana, Mexico. I will be the petitioner. My fiance is Mexican as well Since i have to present my birth certificate to the civil registry in Mexico, the marriage certificate will show me as mexican. Will this be a problem when petitioning him? Or do i have to send my U.S. passport of Naturalization certificate with it to show i am a U.S. Citizen?

    Another question is many years ago (more than 10 years ago), my fiance made the dumb mistake and tried drugs. He hasn't done it since then. He was never caught or been in trouble. Would this come up in his medical testing. If he's asked should he say "yes"? Is this question asked anywhere in the paperwork from start to finish.

    Now i'm nervous.

    Any help or advise would be appreciated.

    As I can see from your profile, you can't file for A K-1 visa after you get married. Never ever try this. That is the first thing you should have to address. K-1 is for UNMARRIED couples. Beside that, the medical thing might not have a problem, if it is that much far.

Hi, i had my interview for k1 visa at London embassy last October and i have been under AP since then, yesterday i called DOS and the lady told me that i should send my passport to the embassy, and she said that the consular section sent me an email requesting my passport 2 weeks ago ( although i checked my email and i haven't received nothing from them) i asked her if AP's cleared she said no, it's still pending but they need my passport!! what is that ??? and i asked her if my case is at the embassy or washington DC and she said embassy.

    Anyway i've sent my passport thourgh royal mail and now i found out that i should've sent it through DX :(:(:(

    what shall i do ? how i'm gonna receive my passport when the visa is issued?? do i have to call DX or the embassy??

    if they are gonna issue me the visa then is it gonna be in a few weeks or it might take months again?

    usually when London ask for passport do they issue visa right away or what ???

    have anyone been through the same situation in the uk? please helppp i'm so anxious :(

    PS ( i didn't send documentation with the passport, i just put it in an envelope and wrote my name, address and case number on it) is this gonna be ok?)

    My fiancee's visa application was on AP and the embassy was let her to keep the passport with her. However, when she was approved for the visa, the embassy emailed her to send the passport so that they can issue the visa and stick it on the passport. I hope yours will be also like that.

    I am so sorry to hear your story. It is really hard to be in this situation. As you said, I think it is a good idea to have a healthy and happy baby. A kid grown in a health family, most probably will have a better life than the other. I advise you to do everything to have a health family. One thing more, get a driving license and drive, have a job. So that you can afford raising your kid as well you will not be totally dependent on your husband. Be adjust your status too. I will pray for you and God be with you

  8. No, they will be out of status meaning they have no legal status until the AOS is filed. But while there is a small risk of detainment, etc. the risks are low and once the AOS is actually filed they will be in a new period of authorized stay (though, depending on how late it was filed, they may be ineligible to leave the country using AP and thus must stay until the GC is received).

    By the way, is there any evidences that I have to send with the I-485? If there, what are they? I know I have support the I-864 but have no clue about the I-485.

    Doesn't matter when you file as long as you got married within 90 days, the visa expired the minute you got in the US.

    So you mean after the marriage the status of a K1 visa holder will be valid even if the 90 days passed ? or what will be the status after that and what is the effect of the late filling on the approval of AOS?

  10. The other day I received a call that there was a letter at VFS for me to pick up. It stated that my administrative processing has been completed please submit your passport and 221g to the VFS/Mumbai Consulate. Does this mean I got approved for my K1 visa or denied. Please let me know if anyone has experienced this.

    If they asked you to submit your passport, it is most probably approval.
