  1. On Sept. 21, 2010, my husband (then fiancé) called me from a pay phone outside the consulate in Juarez. He just had to let me know immediately that his K-1 visa was approved. He came to the US on Oct. 26, 2010 and we were married on Dec 12th. Now, almost 11 years to the day of his K-1 approval, on Sept. 18, 2021 he took the oath to become a US citizen. That was the fastest and easiest part of this whole ordeal. Now we deal with getting the US passport for him and changing his SS status, but we are happy to not have to worry about anything immigration related anymore.

  4. Hi Jay Kay I have a question we are sending in the I485 however my husbands birth certifiacte is in spanish, does he have to have it translated to English? My mother did. I want to know if it has to be translated does it have to be notarized or could I do it myself. I Hope you can help me with this.

      Yes, you need to send a copy of his BC in Spanish and one that has been translated to English. Anyone fluent in both languages can do it. It does not need to be notarized.   5. Hi Jay Kay its me once again I am filling out I-485 and getting all the paperwork together. I have a question and I hope you can help me. His uncle is bein a joint sponsor with me and he completed the I-864 however on the mailing address for my husband he wrote down his address in Mexico. I am aware if he is here with me now, he would have to type in my address right since he is living here with me now? I hope you can help me.

      Yes, the address for your husband(Principal Immigrant) should be the same as yours in the US where you currently live together.

      Are you saying you sent an I-864 from two different joint sponsors? You can only use one of them. Choose the one that has enough income to meet the 125% requirement for their own household size plus your husband. If you use the friend and they need their wife's income to meet the requirement, then the wife has to fill out an I-864A and provide her supporting documents too. He cannot add her income with no proof and form from her. Tax transcripts from the IRS work.

  7. sorry to bother you again but in the affidavit of support my co sponsor only ghas a po box address can i still used him?

      Do they not have a residence? They want the residential address for the co-sponsor, not a mailing address.

      Or if you did not pay online through the website where you scheduled your appointments, you will need to pay the $240 at a Banamex or Scotia Bank in Juarez and bring the receipt of payment with you. http://photos.state.gov/libraries/ciudadjuarez/231771/PDFs/packetk1may.pdf

      If you can go, then you should. The CO might ask if the fiance(e) is there in Juarez with them. You should have already had to pay the $240 fee before filling out the DS-260 and making the ASC and interview appointments.

  12. HELLO JAYKAY ! I RECEIVED A RFE FOR I864, SO I FOUND A NEW SPONSOR, THE THING IS HE MARRIED AND FILES HIS TAXES JOINTLY. MY QUESTION IS DOES HE WIFE NEED TO SIGN A I864A? OR NOT IVE BEEN READING THREADS BUT SOME SAY YES AND SOME SAY NO PLEASE LET ME KNOW ASAP PLEASE AND THANK YOU (PS SORRY IM WRITING IN CAPS LOCKS I DONT KNOW WHY IT WONT LET ME LOWER CASE HEHE ) THANKS

      If his income alone meets the 125% requirement for his household size plus your spouse (3 if it is just him, his wife and your husband), then his wife does not have to provide an I-864A. Have him send his 2012 tax transcript from the IRS plus a copy of his W-2 to show his individual income from 2012. Then also make sure he lists his individual current annual income where it asks on the form, and have him provide proof his current income with a letter from his employer and/or recent pay stubs....

      Another VJ member wrote a step by step guide of going through the website to schedule things. His was based on also having a K-2, but the details of scheduling work for just a single K-1 too.   15. ok never mind its me again. I wen online and applied for the interview. do they give us a date because I cant find where to make the interview.They asked me for the DHL in guadalajara already, but thats it. Do they get in contact with me? because it says the interview and it says I havent made one yet. but I dont know where to go to make it. Hope you can help jay kay and sorry for all my comments.

I understand we need the so called "packet 3" from Juarez but what if it does not arrive? How do we know when the petition is in Juarez already and that we can schedule an interview?

      If it helps, CDJ has never seemed to be very strict about the financials. I do not know if that is changing over time or not, but hopefully they would accept the 100% + his assets. Just provide proof of the value and ownership of any assets he lists. The household size is 6? So, himself, his wife, your fiance and he has 3 other people he claims on his taxes?

      I honestly do not know if CDJ is ok with the 100% for the I-134. The decision is always up to the individual CO. If the officer believes they will not become a public charge, then you will be approved, otherwise they may want a different co-sponsor. It will also probably depend on whether or not you earn any income at all currently. They just need an overall picture that the beneficiary will not need public assistance if granted the visa.

  18. hey jay-kay i am trying to do the DS260 and i am able to do it... does this mean that the case is already in Juarez?

      Not necessarily. If you got the case#, invoice# and beneficiary ID#, from the NVC, you can go ahead and fill it out, pay the fee and schedule your appointments. The NVC should also be able to let you know if they have sent it to CDJ yet.

      That is your past income. Your current income is how much you are currently earning. So, how much you make an hour times how many hours you work a week, then multiply that number by 52 weeks to get your current annual income. Yes, it is gross. Provide letter from employer and most recent pay stubs to prove the current income amount. IF you are self employed, the current income amount will come from line 22 of the most recent(2012) 1040.

      Yes, just need proof of being a US citizen or a legal permanent resident.

      If you get everything filled out and scheduled and your letter from CDJ still doesn't arrive before you need to go to Juarez, then you can go early the first morning you are there and get the letter from the consulate customer service information window.

      Police records are not needed if you had no criminal background. If you were arrested for anything, then you need those records.

  24. Hey jay Kay a quick question. After my fiancée enter the us and we get married do we have to file for aos right away or can we wait a couple of months?

      If you marry within the 90 days, you are eligible to file for AOS. There is no deadline. However, file as soon as you possibly can because they can't work, travel and re-enter the US and will be out of status when the I-94 expires. When you file for AOS, they will be in a new period of authorized stay.
